LETTER OF CONTRACT
the teacher") agree to a contract for regular full-time English teacher as follows.
TEACHER OBLIGATIONS
A. Supervision.
The teacher will work closely with program supervisors and other colleagues in the planning, observation and review of instruction. As a number of -------, the teacher will contribute to the cumulative experience, wisdom and resources of a team dedicated to developing, implementing and evaluating a comprehensive program for teaching English to Korean children.
B. Behavior
The teacher should respect the rules and standards of conduct of -------- (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments. The teacher is required to be punctual, reliable and most of all professional in representing ----------.
C. Workload
The teacher will teach usually a total of 120 hours per a teaching term (=1 month).
In the event that the actual number of teaching hours scheduled for any particular teaching term is below 120 hours, the teacher will be required to devote the remaining hours to related academic work under the supervision of the academic coordinator. The teacher is required to prepare lesson plans, prepare student evaluations, keep accurate records of student attendance and performance, consult with parents, supervise play, attend workshops and teachers meetings and to upgrade their professional knowledge and skills. Staff meetings and school events will be scheduled at the discretion of the institute director. Attendance is required.
Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, methods of training, instruction, curriculum and other matters as needed. Staffs are encouraged to help work out practical solutions to problem at these meetings.
D. Work schedule
The work week runs from Monday through Friday in monthly periods. Hours of operation are from 9:00 am to 7:30 pm. The teacher will be scheduled to teach during this time period by the Institute Director. The teacher should be at the institute no later than 9:00 am.
The teacher is usually, though not necessarily, scheduled in shifts.
TEACHERS BENEFITS
A. Salary: Minimum payment for 120 hours worked in a teaching term is 2,000,000Won.
B. Overtime pay
All teaching hours is excess of 120 teaching hours are considered overtime.
Overtime will be paid at the rate of 16,000won per hour. All teachers may be required to teach overtime. All teachers are required to substitute for other teachers who are sick or absent.
C. Housing
------------ will provide every teacher with an apartment/house shared by other ------------ teachers. The accommodation may be in a two or three-bedroom apartment. Each teacher will have a private bedroom and will share a kitchen and bathroom. Furnishings provided by ----------- for common use include: a kitchen table and chairs, a gas range, a refrigerator, a telephone, a television and a washing machine. Furnishings provided to each teacher include: a bed, a wardrobe and a fan. The cost of monthly service, utilities and telephone charges for the accommodations provided will be paid by the teachers. In the case of a shared apartment, costs will be shared.
D. Health Insurance
The teacher will be covered by medical benefits under a Samsung Fire insurance company. The monthly premium will be shared (50/50) by ---------- and the teacher. Payment will be monthly deducted from teacher's salary.
E. Airfare
--------- shall pay one way airfare between teacher�s place and Korea. If the teacher is in Korea when being hired, the institute shall pay a round-trip airfare between Japan and Korea. In case the teacher fails to complete the contract by his or her own fault or problem, the teacher shall pay back to the --------- the total amount paid by --------- for the airplane ticket.
The return air ticket will be provided at the time of completion of employment. In the event that the teacher continues employment under a subsequent employment agreement with employer, the return air ticket will be provided at the time of completion of the subsequent contract period(s).
F. Teacher training
Before starting to teach, the teacher shall have two or three days of training. During the training period, any for the break between the training and the start of teaching(usually less than a week), the teacher will be in the institute for classroom observation, will receive briefings from the Academic coordinator and the Institute Director and will get acquainted with he local institute policies.
G. Vacation
The work days which are offered in Korea as vacation days number 10 in one contract year as decided by ----------. Five days during the summer time and Five days during the winter time.
H. Severance pay
On completion of one's responsibilities of the full contract period,
2,000,000 won shall be paid as severance pay.
I. Deposit
In case that the teacher may leave not giving --------- any notice, the teacher should put away 200,000 won per month for 3 months to Kids Club as a deposit. When the teacher has something that isn�t paid before he leaves, Kids Club will pay it from the Deposit. Otherwise, All teachers will be paid back again from school when they fulfill their contract and leave.
GENERAL
A. Outside Employment
Employment elsewhere shall not be permitted in accordance with Korean Law. This contract can be terminated or canceled by Kids Club, and the teacher will be punished according to Korean Law, if he / she is found to have other job(such as working at other institute/organizations or giving private lessons) during the term of this contract. It is --------- policy not to give teachers any authorization to work for other language institute and to give private lessons while he/she works for Kids Club until the expiration of this contract.
B. Dress code
Kids Club serves a cross-section of the general public representing various influences, attitudes and opinions. Issues of dress and appearance are sometimes given more weight than warranted, but are an important aspect of the public's perception of each teacher. Therefore, it is necessary that Kids Club establish a policy to ensure that each teacher presents a professional image to the general public. Casual wear is acceptable; however, jeans with holes, wrinkled or dirty clothes and sweat pants are not considered proper attire.
C. Annual pay increase
If both parties choose to renew this contract upon its completion, ------------- will offer the teacher a salary of won. Should the contract be renewed, 7-10 day's unpaid vacation is available to the teacher. The vacation shall be scheduled well in advance on a mutually agreed time period.
D. Taxes/National Pension
South Korean income taxes and national pension will be withheld automatically from teacher's monthly salary. Income tax on the monthly salary runs at about 3.7%
E. Termination of Employment
------------- reserve the right to terminate this agreement for cause with written notification sixty days in advance, and for serious cause without notice. The teacher agrees to give written notification sixty days in advance of intention to terminate this agreement or of interest in renewing it.
F. Contract Period
The period of this contract will be one year, from , 2006 to 2007. If the contract ends in the middle of the term the teacher agrees to teach until the last teaching day of that term. Delays : A delay in a teacher's arrival at the school, or in the opening a new school may call for renegotiation of the contract period. I have read and agreed to the terms and conditions of employment as an English teacher at ---------- Language Institute. In singing this mutual agreement, I understand fully my responsibilities at ---------- Language Institute and accept the position on the basis of the job description in this contract. |

First thing I always check: salary. It sucks and the OT is less than your hourly pay. Good deal, not. |

Kids club - Please let me reiterate what I posted in a previous post then I will make nasty comments about your contract for you. Briefly though, IT SUCKS.
The Kids Club Chain has a less than stellar reputation.
Check with the current teachers about conditions at that particular academy. Talk to MORE THAN ONE teacher. Get their e-mails so you can talk to them when the boss isn't looking over their shoulder.
ASK specific questions about NHIC medical, Pension, OVERTIME and creative book-keeping to avoid paying overtime.
Ask about the number of classes per day, per week and per month.
Ask about class time length and calculation of teaching hours.
ASK about required time in the school (unpaid management/prep time).
ASK about holidays - when and how long each break.
ASK about housing - size and condition.
If you don't ask, then be prepared for a long and ugly year.
You can avoid sending your original diploma by getting certified copies made at your nearest Korean Embassy or Consulate. The fee is usually about USD$3.00 per copy. Get a few (maybe 10) made because you will need one every time you apply for a new visa.
Now on to your contract.
Section C - The teacher will teach usually a total of 120 hours per a teaching term (=1 month). There is no defination of what is a teaching hour. This may mean 120 contact hours per month + administrative duties. This could have you working up to 160 classes per month for the same money as most folks teaching 120 classes per month.
Staff meetings, workshops and school events are another way to say unpaid overtime.
Section D - 9am - 7:30 pm is a 10 1/2 hour day. So much for 120 hours per month.
Teachers benefits - pay rate is 16,666 per class hour but your overtime (that you cannot refuse in this contract) is only 16,000 per hour. Labor law says that overtime should be paid at the rate of 150% of your hourly salary. ( http://english.molab.go.kr/ )
Housing - shared housing is just plain bad news.
Health insurance - this provision is illegal -

Because of the amendment of the National Health Insurance Act on Jul. 13, 2005, without relation to the type of Status of Stay, all foreign workers and overseas Koreans who work for an workplace in Korea shall automatically be the employee insured since 1 January, 2006. If foreign workers made or will make their employment contract with their employer before 1 January, 2006, they will be the employee insured from 1 January, 2006, and if they will make the employment contract with their employer since 2 January, 2006, they will be the employee insured since the first date of employment.
Airfare : there should be no repayment after 6 months and the full value of the homeward flight should be paid at the end of the contract.
UNPAID training is bad news for you - means you teach for free.
Just say no to deposits. If a school feels it needs a 600,000 won deposit to prevent you from leaving early, that probably means that they have had troubles with teachers leaving early in the past. (RED FLAG here).
Outside employment IS legal if approved by the local immigration office.
taxes and pension clause is wrong. Tax is too high and Kids Club usually cheats on pension.

Whenever I see the rules and standards of conduct phrase written in a contract I wonder, "Well, what are they?" Ask about the standards of conduct. What are they? I always say when I evaluate contracts, "Get it written in your contract."

In the event that the actual number of teaching hours scheduled for any particular teaching term is below 120 hours, the teacher will be required to devote the remaining hours to related academic work under the supervision of the academic coordinator.
If your teaching hours fall below 120 per month, then that's not your problem unless decline in census levels are attributable to you. Nevertheless, what academic work is being referred to here? Would you be assisting other students? Get in written in the contract! If you have a set schedule; 2-8, then you shouldn't be working outside those hours to make up hours.
The teacher is required to prepare lesson plans, prepare student evaluations, keep accurate records of student attendance and performance, consult with parents, supervise play, attend workshops and teachers meetings and to upgrade their professional knowledge and skills. Staff meetings and school events will be scheduled at the discretion of the institute director. Attendance is required.
Make sure you have contractual language stating you'll get paid accordingly for hours worked outside your established hours. This work could add up to more than 120 hours per month.
Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, methods of training, instruction, curriculum and other matters as needed. Staffs are encouraged to help work out practical solutions to problem at these meetings.

I would advise you to teach 2p.m.-8pm., or 3p.m. to 9p.m. Try to snag a six hour shifts, same time Monday through Friday, and throughout the whole contract period. Split shifts can be pretty stressful. Anyways, this clause is lacking specifics. What time do you leave work? How long is each class? etc. etc.

The overtime hours are a bit low! Shoot for 22,000 Korean Won per overtime hour. If your teaching another teacher's classes, make sure you have contractual language stating you will be paid accordingly!

*Stick with the Korean National Health Care Insurance Plan
*2.24% of your monthly salary
*It's your employer's responsiblity to deduct 44,800 Korean Won from your monthly salary and contribute it to the National Health Insurance Corporation.
*Your employer pays matches your contributions in one lump sum every 3 months. It shall be 134,440 Korean Won throughout the contract period.

It would also be a good idea to include contractual language stating you shall not pay back the total costs of the airline ticket to the employer for reasons attributable to the employer. Well.... I would say it a little nicer than that..... Refer to Article 26 of the Korean Labor Standards Act.
The return air ticket will be provided at the time of completion of employment. In the event that the teacher continues employment under a subsequent employment agreement with employer, the return air ticket will be provided at the time of completion of the subsequent contract period(s).

This is another way of them saying we'll pay you 40-50% less per hour during training! You should do all teacher training after you've been issued an E2 Visa!

Negatory to housing deposits! Don't agree to this. There have been to many cases of teachers not getting housing deposits back.

-This crook says you should pay 3.7% @ 74,000! I don't think so.... He wants to take an extra 45,050 Korean Won per month from your monthly salary per withholding tax.

You should have "The teacher shall start working for the employer when the teacher has been issued an E2 Visa from Korean Immigration. After the teacher has been issued an E2 Visa from Korean Immigration, the teacher will work for the employer for a period not exceeding one year in length. The teacher's employment dates shall be from _____/_____/_____ until _____/_____/_____."

TEACHER OBLIGATIONS
A. Supervision.
The teacher will work closely with program supervisors and other colleagues in the planning, observation and review of instruction. As a number of -------, the teacher will contribute to the cumulative experience, wisdom and resources of a team dedicated to developing, implementing and evaluating a comprehensive program for teaching English to Korean children.
B. Behavior
The teacher should respect the rules and standards of conduct of -------- (written, verbal and tacit) and obey the laws, regulations, instructions, and ordinances of the national and local governments. The teacher is required to be punctual, reliable and most of all professional in representing ----------.
C. Workload
The teacher will teach usually a total of 120 hours per a teaching term (=1 month).
Never agree to hours per month agree to 120 50 minute classes per month or the equivalent. 120 hours = 7200 minutes...if they divvy that up into 40 minute classes and only count the time in class you end up teaching 180 classes a month....thats 45 classes a week which is 9 classes a day....way too much work!
In the event that the actual number of teaching hours scheduled for any particular teaching term is below 120 hours, the teacher will be required to devote the remaining hours to related academic work under the supervision of the academic coordinator. The teacher is required to prepare lesson plans, prepare student evaluations, keep accurate records of student attendance and performance, consult with parents, supervise play, attend workshops and teachers meetings and to upgrade their professional knowledge and skills. Staff meetings and school events will be scheduled at the discretion of the institute director. Attendance is required.

Staff meetings will allow time for discussion of topics of current concern within the program such as new policies, procedures, methods of training, instruction, curriculum and other matters as needed. Staffs are encouraged to help work out practical solutions to problem at these meetings.
D. Work schedule
The work week runs from Monday through Friday in monthly periods. Hours of operation are from 9:00 am to 7:30 pm. The teacher will be scheduled to teach during this time period by the Institute Director. The teacher should be at the institute no later than 9:00 am.
The teacher is usually, though not necessarily, scheduled in shifts.
10.5 hour days...nuff said....I would never take this job!....ooh great split shifts!
TEACHERS BENEFITS
A. Salary: Minimum payment for 120 hours worked in a teaching term is 2,000,000Won.
Crap pay for a crap contract! 52.5 hours a week....for 2 mil burn the contract and send it back to them in an envelope!
B. Overtime pay
All teaching hours is excess of 120 teaching hours are considered overtime.
Overtime will be paid at the rate of 16,000won per hour. All teachers may be required to teach overtime. All teachers are required to substitute for other teachers who are sick or absent.
crap overtime! Mandatory overtime! has anyone mentioned how crappy this contract is yet?
C. Housing
------------ will provide every teacher with an apartment/house shared by other ------------ teachers. The accommodation may be in a two or three-bedroom apartment. Each teacher will have a private bedroom and will share a kitchen and bathroom. Furnishings provided by ----------- for common use include: a kitchen table and chairs, a gas range, a refrigerator, a telephone, a television and a washing machine. Furnishings provided to each teacher include: a bed, a wardrobe and a fan. The cost of monthly service, utilities and telephone charges for the accommodations provided will be paid by the teachers. In the case of a shared apartment, costs will be shared.
Shared accomodations no air con D. Health Insurance
The teacher will be covered by medical benefits under a Samsung Fire insurance company. The monthly premium will be shared (50/50) by ---------- and the teacher. Payment will be monthly deducted from teacher's salary.

E. Airfare
--------- shall pay one way airfare between teacher’s place and Korea. If the teacher is in Korea when being hired, the institute shall pay a round-trip airfare between Japan and Korea. In case the teacher fails to complete the contract by his or her own fault or problem, the teacher shall pay back to the --------- the total amount paid by --------- for the airplane ticket.
After 6 months you shouldnt be responsible for the airfare to Korea!
The return air ticket will be provided at the time of completion of employment. In the event that the teacher continues employment under a subsequent employment agreement with employer, the return air ticket will be provided at the time of completion of the subsequent contract period(s).
You should get roundtrip airfare paid out if you dont go home after
F. Teacher training
Before starting to teach, the teacher shall have two or three days of training. During the training period, any for the break between the training and the start of teaching(usually less than a week), the teacher will be in the institute for classroom observation, will receive briefings from the Academic coordinator and the Institute Director and will get acquainted with he local institute policies.
G. Vacation
The work days which are offered in Korea as vacation days number 10 in one contract year as decided by ----------. Five days during the summer time and Five days during the winter time.
H. Severance pay
On completion of one's responsibilities of the full contract period,
2,000,000 won shall be paid as severance pay.
I. Deposit
In case that the teacher may leave not giving --------- any notice, the teacher should put away 200,000 won per month for 3 months to Kids Club as a deposit. When the teacher has something that isn’t paid before he leaves, Kids Club will pay it from the Deposit. Otherwise, All teachers will be paid back again from school when they fulfill their contract and leave.
Illegal....and a perfect way of telling people that things here are so bad teachers often do runners to get away....so we want you to give us some of your money to cut our costs.
GENERAL
A. Outside Employment
Employment elsewhere shall not be permitted in accordance with Korean Law. This contract can be terminated or canceled by Kids Club, and the teacher will be punished according to Korean Law, if he / she is found to have other job(such as working at other institute/organizations or giving private lessons) during the term of this contract. It is --------- policy not to give teachers any authorization to work for other language institute and to give private lessons while he/she works for Kids Club until the expiration of this contract.
B. Dress code
Kids Club serves a cross-section of the general public representing various influences, attitudes and opinions. Issues of dress and appearance are sometimes given more weight than warranted, but are an important aspect of the public's perception of each teacher. Therefore, it is necessary that Kids Club establish a policy to ensure that each teacher presents a professional image to the general public. Casual wear is acceptable; however, jeans with holes, wrinkled or dirty clothes and sweat pants are not considered proper attire.
C. Annual pay increase
If both parties choose to renew this contract upon its completion, ------------- will offer the teacher a salary of won. Should the contract be renewed, 7-10 day's unpaid vacation is available to the teacher. The vacation shall be scheduled well in advance on a mutually agreed time period.
D. Taxes/National Pension
South Korean income taxes and national pension will be withheld automatically from teacher's monthly salary. Income tax on the monthly salary runs at about 3.7%

E. Termination of Employment
------------- reserve the right to terminate this agreement for cause with written notification sixty days in advance, and for serious cause without notice. The teacher agrees to give written notification sixty days in advance of intention to terminate this agreement or of interest in renewing it.
F. Contract Period
The period of this contract will be one year, from , 2006 to 2007. If the contract ends in the middle of the term the teacher agrees to teach until the last teaching day of that term.
Not a chance....its up to them to organise their teachers arrival...not for you to stick it out because of their incompetance...perhaps if they offered you an additional 500,000 won over and above your salary for helping them out I would agree
Delays : A delay in a teacher's arrival at the school, or in the opening a new school may call for renegotiation of the contract period.
