Hi,
Thank you all, I am sure you get tired of doing this = ) could you please tell me what you think of this contract? I realy want to work in korea!
Article 1 (Purpose)
This contract is made for the purpose of setting forth the terms and conditions of employment for native English teachers who work in Korea XXX (hereinafter
Article 2 (Status of Employment)
Employee shall be hired pursuant to this Contract as an English Language Instructor (ELI).
Article 3 (Duties)
The ELI shall perform the following duties:
1. Plan and conduct English classes in levels assigned by
Employer, using texts and course syllabi approved by Employer;
2. Assist with and participate in activities related to the i
instructional programs of xxx, including, but not limited to,
departmental planning meetings, general faculty meetings, and
special presentations;
3. Assist with projects related to the activities concerning i
international cooperation carried out by xxxx;
4. Assist Employer with out-of-classroom activities related to the
regular curriculum of xxxx, including, but not limited to, field
trips and school-wide assemblies, as well as other
extracurricular activities within xxxx;
5. Assist with the development of teaching materials,
supplementary materials, tests, evaluations, and other
programs related to English language teaching;
6. To assist or conduct teacher training for new ELIs under the
direction of Employer;
7. To assist, monitor, and supervise ELIs in their teaching
methodology and implementation, and classroom conduct
under the direction of Employer;
8. To perform other duties directly related to student education
and assessment as designated by Employer;
9. All materials developed by Employee while working for xxxx will
become the property of xxx, and Employee shall not seek
compensation and/or payment beyond what is stated in this Contract.

Article 4 (Supervision)
Employee shall carry out the duties set forth in the foregoing Article 3 pursuant to and under specific instruction with supervision of the Employer during the period of employment.
Article 5 (Period of Employment)
The period of Employment shall commence on _________, 2006 and end on ________, 2007, beginning and ending within the Republic of Korea.
Article 6 (Work Hours)
1. Employee shall work eight ( hours per day for five (5) days per week on Monday to Friday, and shall not work on Saturdays, Sundays, and any national holidays of the Republic of Korea, with the exception of the day(s) stipulated in Article 6-2. Actual class instruction hours of Employee shall be six (6) hours with two (2) hours (predetermined by Employer) for class material preparation.
2. Employee shall assist and participate in Teacher Workshops. The day(s) of these workshops shall be decided by xxxx schedule, and these day(s) may fall on the weekend.
Article 7 (Salary)
1. According to Article 6, Employee shall be paid the total amount of xxx million Korean Won per month.
2. According to the pertinent laws of the Republic of Korea, all applicable taxes, including, but not limited to, the Korean income tax and pension contributions, shall be withheld each month from Employee�s salary.
3. Employee's salary shall be paid on a pro rata basis the (10) tenth day of each month. If this day falls on a National Holiday, Saturday or Sunday, the salary will be paid on the immediately following business day.
4. When Employee has not worked a full month, salary for that month shall be paid on a pro rata basis either from the first day or until the last day of work.
5. If Employee should be absent from work without having obtained a prior approval, Employee's salary for that month shall be deducted by the amount calculated on a pro rata basis for the number of unauthorized absent days.
6. If Employee works fully until the end of the Period of Employment, Employer shall pay Employee severance pay, equivalent to the amount stated in Article 7-1.
7. Employee shall not claim against Employer any compensation and/or payment other than those provided for in this Contract.

Article 8 (Housing)
1. Employer shall provide Employee with housing selected by Employer, and Employer shall pay full monthly rent and deposit on the housing selected. Housing selected by Employer may include a leased house, studio, or apartment. Any and all fees, charges, costs, taxes, expenses, etc., incurred in using the housing shall be paid by Employee.
2. If Employee chooses not to accept the housing provided by Employer, Employer shall provide Employee with 200,000 Korean Won per month as a rent subsidy in lieu of the housing set forth in the foregoing
Article 8-1.
3. Employer shall provide temporary housing should appropriate housing for Employee not be immediately available.
4. If Employer provides housing to Employee, Employer shall provide appliances and furniture (specifically: a bed, stove, refrigerator, TV, washing machine, air conditioner, and telephone), and Employee shall not request or demand any other appliances or furniture other than those provided by Employer.
Article 9 (Airfare)
1. Employer shall provide the Employee one-way economy-class airfare for the most direct route from the city where the Korean Embassy/Consulate to which the Employee submitted his/her VISA application is located and Seoul-Incheon International Airport.
2. All connecting flights within the Employee�s home country, or any other flights not provided for in the travel itinerary authorized by Employer, shall be paid for by Employee.
3. If Employee�s contract is terminated, whether by Employee or Employer, within six months of the contract commencement date, Employee shall repay the price of the ticket on a pro rata basis calculating the number of days that the Employee has worked since the start of Employment. If Employee�s contract is terminated, whether by Employee or Employer, after six months of the contract commencement date, Employee shall pay the price of a return ticket (as defined in Article 9-4) on a pro rata basis calculating the number of days that the Employee has worked after the six-month point.
4. After Employee has completed the full period of employment, and all duties within that period, Employer shall provide the Employee one-way economy airfare for the most direct route from Seoul-Incheon International Airport to the city where the Korean Embassy/Consulate to which the Employee submitted his/her VISA application is located.
Article 10 (Other Benefits)
Employer shall provide Employee with medical insurance through an insurance company. Fifty (50) percent of medical insurance premiums and fees shall be paid by Employee, and fifty (50) percent shall be paid by Employer.

Article 11 (Paid Leave)
1. Employee shall be entitled to a paid leave for a total of two working weeks during the Period of the Employment set forth in Article 5.
2. Employer shall decide the period of Paid Leave according to xxxx schedule.
3. Employee shall be entitled to a sick leave for a total of 5 days, during the full term of Contract, with having obtained a prior approval. Sick leave offered by xxxx is a benefit given to Employees on the assumption Employee fulfills his/her Employment Contract. In the event Employee is unable to fulfill his/her full Contract, Employee will pay back a portion of Employee�s salary equivalent to the total number of sick days used by Employee.
Article 12 (Codes of Conduct)
1. Employee shall not behave in any manner that may damage or tarnish the reputation of the teaching profession. Employee shall comply with and observe any codes of conduct applicable to Korean teachers.
2. Under Korean immigration law, Employee shall not receive pay from any other job, including a part time job, outside the duties of xxxx, during the Term of Employment set forth under Article 5.
3. Employee shall not be involved in any activities, which may cause harm to the students or be of detriment to the reputation of xxxx.

Article 13 (Termination of the Contract)
1. Resignation
If Employee wishes to resign from the xxxx and terminate this contract, he/she must give Employer thirty (30) days prior, written notice of resignation stating a date of and a reason for resignation. If Employee chooses to resign, the airfare for the return flight shall be paid by Employee, and his/her VISA shall be cancelled.
2. Termination by Employer
Employer may terminate this Contract for any one of the following reasons:
①. If Employee violates the laws of the Republic of Korea.
②. If Employee fails to perform or unsatisfactorily performs any of the duties stipulated in this Contract for any reason.
③. If Employee is absent from work for more than three (3) days without Employer�s authorization.
④. If it is determined that Employee is prevented from or incapable of performing his/her duties set forth in Article 3 hereof for a medical reason, whether it is a physical or psychological ailment. (If requested by Employer, Employee must be immediately available for a medical examination.)
In the event that this Contract is terminated pursuant to the foregoing Article 13, Employer shall pay Employee a pro rated, monthly salary based on the number of days actually worked by Employee during his/her last month of employment. The Employee shall immediately refund the airfare loan according to the terms under Article 9.
Article 14 (Confidentiality Agreement)
This Contract, and all its contents, is entered into on the basis of a strict, confidential agreement between Employee and Employer. Employee shall not disclose any information, and/or contents of this Contract to any third parties without having received prior approval from Employer. Unauthorized disclosure of this Contract, in whole or in part, whether intentional or unintentional, shall result in immediate termination of Contract. In such a case, it shall be considered a termination of contract on Employee�s part and the terms of Article 13 shall be applied.
Article 15 (Miscellaneous)
Matters not explicitly stated in the Contract shall be negotiated by Employer and Employee until a solution acceptable to both parties is agreed upon.
Article 16 (Indemnity)
Employee shall indemnify for and keep Employer harmless from any liability or damages arising from, or in relation to any negligent or illegal activity of Employee, whether intentional or unintentional, during the Period of Employment under this Contract.

Article 17 (Governing Law and Venue)
The terms of this Contract and the rights and obligations of the parties named herein shall be interpreted solely according to the laws of the Republic of Korea. If a dispute or disagreement arises in connection with this Contract, the parties shall first try to resolve it in good faith. However, if the parties fail to resolve such disputes to their mutual satisfaction, their disputes shall be resolved by arbitration in Seoul, Republic of Korea, according to Commercial Arbitration Rules of the Korean Commercial Arbitration Board.
Article 18 (Signature)
In witness whereof, the parties hereto sign Contract in triplicate on the date entered below with each party retaining one copy and submitting the third copy for Employee's visa application.

This is a very bad contract. 8 hours a day 2 of them for class preparation. The average school offers 120 hours a month. This deal has you working 160 hours per month.
Also too many duties. You are a teacher. Not a teacher trainer, not a curriculum developer, a teacher. Workshops may be held on the weekend? That means they will. You could end up working 7 days a week as this is not defined at all .
The amount of tax and pension is not defined? Bad idea. You are paid on the 10th. Nope it should be the 5th at the latest. They do this to protect against runners...and something tells me that they have/had a lot of them.
Medical insurance through an insurance company. No way Jose! You are supposed to be covered under the national plan..they are trying to save money and give you cheap medical care.
My thoughts....DON'T sign. You can do MUCH MUCH better. This contract is really too bad for words. If you sign get ready for a year of hell on earth. |

I been looking now for a month this was the best contract so far. LOL
I want to work in korea but were do i find a decent job? any help is appreciated. |

Not a good start! The contract is between the employer and the employee...it really has nothing to do with English teachers! Gods forbid we all get stuck with this peice of crap contract!

? I thought they were hiring you as an ELI? This seems far outside that scope!

I would want a list of what is to be expected! This is much too general!

again this should be provided to you!

more craziness...you are an ELI not an ELI instructor!

2 hours prep time is way too much! Never agree to hours! Agree to classes IE 5 fifty minute classes a day between the hours of 2-8

it should be nearest international airport to employees home...in Canada there are embassies in Vancouver, Montreal and Ottawa.....leaves you kind of screwed if you come from the prairies!

codes of conduct need to be listed or attached! Otherwise they will make them up as they go along....besides I have seen Korean public school teachers drinking in their classrooms as well as smoking

if the employer terminates the contract 30 days notice will be given to the employee or one months pay in lue of notice!

Sorry but you can always take a contract to the labour board! They cannot stop you from protecting yourself!

No set hours! Too many hours being demanded...6 classroom hours could be 7 classes a day....add in those 2 hours for prep and all the sudden you are at the school for 9 hours + a day....which makes 180 hours a month....lots of extra time for no pay!
Way too many duties as well!

I appreciate the help!
i been searching for a month and been sent tons of contracts all worse than that one.
I love asian culture love travel adapt quickly etc. but i do not seem to have much luck in finding anything worth while. I SO SO not doing this for the money I am leaving a well paid job june 30th to do this.
so I was thinking what if i put my own contract together made it fair then sent it out with my resume? would that be a insult?
grrrrr me just want a decent place............. |

I have known a couple of teachers who put their own contracts together.
Simple is best!
______________ agrees to teach English for ______________ at ___________ from ____________ to ____________.
A salary of 2,300,000 won will be paid per month for teaching 30 fifty minute classes a week. Any classes in excess of 30 per week will be considered overtime! Overtime will be paid out at the rate of 25,000 won per 50 minute class. A teaching hour is hereby determined to be fifty(50) minutes.
Salary will be paid on the 5'th of the month or before, if the 5'th falls on a holiday or weekend.
I _______________agree to teach 30 fifty minute classes between the hours of 2-8:30 from Mon to Fri. The teacher will be allowed a dinner break from 5:00 to 5:30PM.
I will arrive at the school thirty(30) minutes prior to my first classevery in order to prepare for my classes.
All teaching materials will be provided to the teacher. The teacher can recommend and suppliment teaching materials if approved by the school. All materials will be returned to the school once the teacher is done with them.
Deductions: Pension in the amount of 4.5% of the employees salary will be deducted matched by an equal amount by the employer.
Health care provided by NHIC will be deducted in the amount of 2.24% matched by an equal amount by the employer.
Taxes will be deducted in the amount of 49,330 won per month. In the event the employee works overtime this rate will be adjusted according to the national tax service "monthly withholding tax".
Economy airfare will be provided from the nearest international airport to the employees home to Incheon airport in Korea. At the end of the contract the employee has an option to return there or accept 80% cash value in lue of a ticket. In the event the employee needs to do a visa run to Japan the employer will cover all costs associated with the visa run(accomodations, travel, meals). In any event the employer will pay any costs associated with acquiring the visa.
In the event the employee does not finish the contract the airfare will be deducted in a pro-rated manner. After 6 months though the employee will no longer be libel for the airfare to Korea.
The employee is entitled to 5 sick days per year. A doctors note will be required if the employee misses two or more days consequetively. IF the employee does not use any of his sick leave he will be rewarded at the end of the contract at the rate of 80,000 won per day of unused sick leave.
Severance: At the end of the contract the employee will recieve a payment equal to a months salary. 2,300,000 won
The usual clause (in case of war/criminal act...etc) the employer reserves the right to terminate this contract immediately.
If for any other reason either party wishes to terminate the contract 30 days notice will be given.

I'm looking for a job right now too. I've put together a list of things that would be in my ideal contract. Every contract that I've been getting in I've been holding up against this test.
I've been searching about a week and so far I have one school that can meet all my standards. Hopefully it will go through, but I want to talk to the teachers at the school first before I sign.
Anyways, here is my criteria. Some may be personal preferences, but most are standard things you should look for in a contract.
--Location within Seoul or Suwon. No multiple locations.
--Maximum of 120 teaching hours. Teaching schedule specified�hopefully an afternoon schedule (eg. 2-9 p.m.) Ideally, a 30-40 minute supper break should be available somewhere in the schedule.
--Monday to Friday (no Saturdays)
--Minimum of 2 million Won per month. Prefer 2.1 or 2.2 million Won for experience.
--No split shifts.
--Single, furnished accommodation within walking distance of work. Ideally, no deposit will be deducted off initial pays.
--National Health Insurance Plan�2.24 % deducted off pay (number should be specified).
--National Pension Plan contributions�.4.5 % deducted off pay (number should be specified).
--Info about taxes�eg. 1.6 % deducted for 2 million won (number for base salary should be specified).
--Return airfare provided from the nearest international airport (Ottawa, Canada) to Incheon. The return ticket will be provided upon completion of contract. I should have the option for a cash settlement instead of the plane ticket. The cash settlement should be the equivalent of a return air ticket from Seoul to Ottawa on the date my contract ends.
--Severance pay at end of contract that is the equivalent of one month�s pay.
--Visa sponsorship. E-2 Visa only.
--Three paid sick days.
--10 days of paid holidays.
--National Holidays off and paid.
--25,000 Won overtime pay.
--Indication of a curriculum.
--Indication of a training program.
--Small class size (8-10 students).
--Although I don�t mind teaching kindergarten students, I don�t want to teach ONLY kindergarten students. |

Yeah, well I guess they think they can get all pissy on you for offerring a higher than normal salary.
Screw them! No set schedule and teaching hour defined on top of all the other crap! |
