Hello again

Yes another post, another contract!!!


Sorry about this but I can feel the right contract is close!! Very Happy

The recruiter says that this contract is NON NEGOTIABLE!! I thought everything was negotiable in Korea!! Laughing

If anyone can spare the time to offer any advice would be greatly appreciated!! This is the first Public School contract I have seen and it seems a little more in depth than the Hagwon contract I am usually offered so really any help anyone could give would be great!



I have picked a few bad points for me so far.....

They pay on the 15th of the month which sounds suspect! But it sounds like they may pay me on the 15th if I start on the 1st which wouldn't be so bad would it?

I have to pay for my tickets and visa which I have e mailed the recruiter about she says they may pay the flight up front for me if I can get there sooner than my proposed start date of Sept 1st!

I pay for my ARC which for 10,000 I am not really too bothered about!!!


60 day notice!!

100,000 resigning bonus (vacation bonus) seems low but to be honest no other school has offered me this!! Would this replace my severance though??

Possibility of on campus housing! OUCH!

Set holidays only to be taken when school is closed!!!





But I am sure there are a few potholes in there that I have missed!!




CONTRACT FOR TEACHERS TO ( ) ELEMENTARY SCHOOL

This employment Contract (hereinafter this �contract�) is made by and entered into between ( ) Elementary
school, the Republic of Korea (hereinafter �Employer�), and the native English teacher, ( ) (hereinafter �Employee�) a (an) England citizen residing at .

1. (Purpose) This contract is made for the purpose of setting forth the terms and conditions of employment for assistant
teachers who will teach English at ( ) elementary school.

2. (Status of employment) Employee shall be hired pursuant to this contract a [□1st level English language instructor
(ELI)/ □ 2nd level ELI/ □ 3rd level ELI]

3. Salary shall differ from status of employment. (Confer Appendix 1)


Article 2(Duties) Employee shall perform the following duties.
1. Grading and evaluation of students.
2. Attendance by 11:00 AM, finished by 5:00 PM.
3. Attendance at teacher's meetings and workshops.
4. To do lesson planning and develop teaching materials with a Korean co-teacher.
5. To be involved in extra-curricular classes, teacher training, or English camps requested by the school.
6. To be involved in other activities relevant to English teaching
7. Giving feedback to students who have given their on-line video presentation.
8. Feedback must be fulfilled twice a month.
9. Feedback video clip file must be 50 ~ 60 sec in length.
제3조(고용기간) 고용기간은 2006 년 월 일부터 2007 년 월 일까지로 한다.
Article 3 (Term of employment) The term of Employment shall begin on , 2006 and end on , 2007.

Article 4(Airfare and Resignation)
1. The airfare for Employee�s flight, actual purchasing price, to Korea shall be reimbursed by employer based on an
economy class airfare of the most direct flights available from his/her permanent residence to Incheon International
Airport.

a. Teacher residing outside of Korea: The Employer shall pay for airfare between the nearest International Airport
from the Employee's place of residency and the Incheon international airport in Korea. Airfare will be paid in the
following fashion: A one-way ticket to Korea will be reimbursed after Employee�s arrival in Korea and after the
completion of the employment contract a one-way ticket to the airport of departure will be provided
b. Teacher residing in Korea: Teachers hired in country shall have the visa trip to the nearest country from Korea
(round-trip airfare & E-2 visa pick up cost 60,000won & other cost 90,000won) reimbursed by the Employer.
After the completion of the employment contract a one-way ticket to the Employee�s foreign residence will be
provided.
c. Once the Employee receive E-2 visa, Employee must apply Alien card at the immigration office which is
indispensable card to live in Korea. It will cost 10,000won for the stamp, and it will not be reimbursed by
Employer.
2. If Employee should desire to resign during the Term of Employment, he/she must give Employer a sixty (60) day
prior written notice of resignation stating a date of and a reason for resignation.
3. In the case of Employee�s resignation, the airfare for his/her return trip shall be borne by Employee and his/her visa
shall be cancelled.
4. In the event that Employee to return home before completing the contract for reasons beyond his/her control, the
airfare for his/her returns trip may be provided by Employer.
5. In case of the termination of this Contract within six (6) months, Employee shall immediately pay back 100% of the
one-way airfare to Employer. If Employee works more than six (6) months during the term of employment,
Employee�s obligation to pay back the reimbursement provided pursuant to this provision shall be waived by
Employer.

Article 5(Work Hours)

1. Employee shall work five (5) hours per day (excluding lunch hour) for five (5) calendar days per week
from Monday to Friday and shall not work on Saturdays, Sundays and Korean national holidays.
2. An employee is required to complete minimum 40 working days within a term of 2 months. If there are unexpected or
expected missing classes due to the school�s schedule, (picnic, sports day etc.) the employee must make up for the
missed classes within the same term.
3. Employee�s regular working hours shall not exceed thirty (25) hours per week. Employee may be asked to teach some
extra classes. Extra teaching hours should not exceed 5 hours a week, and it is employee�s decision to accept extra
teaching hours.
4. Employee shall be paid for the extra working hours. (23,000won / hr)
5. Employee must complete the feedback job on time. (Max. 1 week)
6. Starting time can be different during school vacations. (ex. 10:00 ~ 16:00)
7. If Employee should be late for the class over 30 minutes, Employer must give an official warning and the salary will
be deducted for 15,400won.

제6조(보수)
Article 6(Salary)

1. Employee shall be paid 2.0 won per month. However, the Korean income tax (3.3%), medical insurance as
required under Korea law shall be withheld each month from Employee�s salary. (50% of medical insurance will be
supported by employer.)

2. Employee�s salary from 1st day of the month to last day of the month shall be paid on the 15th of month following
each pay period. If this day falls on a National Holiday, Saturday or Sunday, the salary will be paid on the
immediately preceding business day.
3. When Employee has not worked a full month, salary for that month shall be paid on a pro rata daily basis either from
the first day or until the last day of previous month.
4. If Employee should be absent from Work without a prior approval, his or her salary for that month shall be deducted
by the amount calculated on a pro rata daily basis for the number of unauthorized absent days.
5. Upon completion of a one-year contract, Employer shall pay Employee thirty (30) calendar days� average wage as a
severance pay for Employee�s continuous employment of one year.
6. Employee shall not claim against Employer any compensation and/or payment other than those provided for in this Contract.
7. Employee whose contract is renewed for a second term or subsequent terms may be eligible for an increase in salary.
The increase is not automatic and will depend, in all cases, upon the Employee�s teaching performance and
contribution toward the achievement of the educational goals of ( ) elementary school.
제7조(계약만료)

Article 7(Contract Completion)
1. The Term of Employment stated in Article 3 may be renewed by a mutual written agreement between Employer and
Employee, provided that each renewed employment term is one (1) year.
2. If Employee completes the Term of Employment and leaves Korea within 14 days from the expiration date, Employer
shall pay for Employee�s return flight.
3. Once employee resigns on the contract with employer for another year, employee shall have 5 days paid vacation and
be paid a vacation budget for 100,000won.

제8조(주거)
Article 8(Housing)
1. Employer shall provide Employee with housing. All efforts will be made to provide an apartment within walking
distance of the school.
2. Housing selected by Employer may be, including but not limited to, a leased house, dormitory, or an apartment. A
single teacher will be provided with a one-room apartment on or off campus, and a married couple will be provided
with a residence with at least two bedrooms. Any and all fees, charges, costs, taxes, expenses, etc. incurred in using
the housing shall be borne by Employee.
3. Employer may provide temporary housing until the appropriate housing for Employee becomes available. If
Employer is not able to provide housing for Employee, Employer shall provide Employee with 400,000 won per
month, as a rent subsidy, in lieu of the housing set forth in the foregoing 1.

4. Employer shall decide whether to provide Employee with housing or a rent subsidy. Once decided, Employer�s
decision shall not be subsequently changed during the Term of Employment.
5. If Employer provides housing to Employee, Employer may provide appliances and furniture (confer appendix 1).
Employee shall not request or demand any other appliances or furniture than those provided by Employer. Employee
shall take the responsibility for the maintenance and repair for the appliances and furniture provided by Employer.
6. Employer will provide Employee with 100,000 won as relocation money after he/she, who has been provided the
house by the employer, has signed first contract. Employee must spend the money to buy basics of life other than
those set forth under Article 8, item 5.

Article 9(Other Benefits)
1. Employee who is working in a designated rural area shall be entitled to be paid allowance of 100,000 won every
month.
2. Employer shall decide where a designated rural area is or not.
제10조 (유급휴가)

Article 10 (Paid Leave)
1. Employee shall be entitled to a paid leave for a total of ten (10) working days during the term of the employment. Paid
leave may be taken at any time school is not in session. Saturday and Sunday do not count as vacation days. If Employee
renews the contract, up to 3 days of unused yearly paid leave may be carried over to the new contract period. This carried
over paid leave may be used in the new contract period, but it may not be carried over into any subsequent contract
period.


Article 11(Sick Leave)
1. Employee shall be entitled to a paid sick leave if an illness or injury prevents him/her from performing the duties
under this contract, provided, however, that he/she obtains Employer�s prior consent.
2. These sick days must be validated through a signed release from a doctor.
3. If Employee should not submit a written diagnosis, a sick leave may be regarded as an unpaid leave.
4. Paid sick leaves are 3 days a year.

Article 12(Office Regulations and Restrictions)
1. Employee shall faithfully observe his/her Director�s requests on his/her duties defined in Contract.
2. Director shall evaluate Employee�s performance of official duties under a guideline.
3. Employee shall devote his/her full working hours and occupational attention to the defined duties in these terms and
conditions, except for cases specially provided.
4. Employee shall not damage or tarnish the reputation of the teaching profession. Employee shall comply with and
observe any codes of conduct acceptable for Korean teachers.

5. Without Director�s permission, Employee shall not be employed or involved in other paid business (including a part-time job).
6. If Employee has a contagious disease or other illness as set out in the following items, Director may prevent
Employee from performing duties.
i. The fear exists that Employee with a contagious disease is not taking measures to prevent the spread of the
disease.
ii. The fear exists that labor will significantly worsen Employee�s disease from which Employee suffers.
iii. Employee is affected by a disease as determined by the Ministry of Health and Welfare.
iv. Item 1 to item 3 are to be paid for.

Article 13(Termination of the Contract)
1. Employer may terminate or cancel this Contract upon occurrence of any one of the following events;
a. If Employee violates the laws of the Republic of Korea.
b. If Employee fails to perform or unsatisfactorily perform any of the duties stipulated in this contract.
c. If Employee fails to perform continuously his/her duties for more than 3 days without any excuse.
d. If any of the information provided in Employee�s application is neither true nor accurate.
e. If it is determined that Employee is prevented from or incapable of performing his/her duties set forth in Article
hereof for a medical reason, whether it is a physical or psychological ailment.(If requested by Employer,
Employee must be immediately available for a medical examination.)
2. In the event that this contract is terminated pursuant to the foregoing 1, Employer shall pay Employee a pro rated
salary based on the number of days Employee actually worked for. In this case, Employee shall be responsible for
his/her return trip to his/her home country. Employee�s visa will subsequently be cancelled.
3. In the event of termination of this Contract pursuant to any of the provision set forth in the foregoing 1, Employee
shall immediately refund the loan to Employer according to Article 7, item 3.
4. If Employee is sentenced to a term of imprisonment (or any other more severe penalty), Employee shall automatically
be dismissed and Employer will not provide any financial compensation.
제14조(계약 외 사항) 본 계약서에 규정되지 않은 기타 사항은 피고용자의 의견을 수렴하여 고용자가 정한다.
Article 14 (Matters not explicitly stated in the Contract) Matters not explicitly stated in the Contract shall be determined
by Employer by taking Employee�s concerns into consideration.
제15조(손해배상)

Article 15(Indemnity)
1. Employee shall be indemnified against and protect Employer from any liability or damages arising from or in relation
to any negligent, faulty, or illegal activity of Employee during the Term of Employment under this contract.
2. Employer shall check the leased facilities and financial matters arising from the use of them by Employee before the
Term of Employment is completed. If any liability or damages are found, these shall be confirmed in written form by
Employee, who will be indemnified from the security deposit pursuant to the foregoing 1. In the case of the
insufficient security of indemnity pursuant to the foregoing 1, Employer shall demand further compensation. In the
case of protecting Employer from any liability or damages, Employee shall get refunded the whole amount of money
secured in advance before the termination of the contract.

제16조 (사전연수)
1. 피고용자는 제3조에서 명시된 고용개시일 직전 (주)웅진씽크빅에서 실시하는 WEST를 이수하여야 한다.
Article 16 (Attending the training program)
1. Employee shall complete WEST(Woongjin English Star Teacher Training) conducted by Woongjin Thinkbig Co., Ltd.
immediately before the commencement of the Term of Employment provided under Article 3 hereof.
Article 17 (Governing Law, Language and Venue)
1. The terms of this contract and the rights and obligation of the parties hereto shall be construed, interpreted and
determined in accordance with the laws of the Republic of Korea.
2. The Governing language of the contract shall be English & Korean. The translations of both are the same.
3. If a dispute or disagreement should arise in connection with or out of this Contract, the parties hereto shall first try to
resolve it in accordance with a principle of good faith. However, if the parties fail to mutually resolve such disputes
or disagreements or come to amicable settlements, their disputes or disagreements shall be finally resolved by
arbitration of the Korean Commercial Arbitration Board.
제18조(서명) 고용자와 피고용자는 본 계약서 말미에 기재된 날짜에 본 건 계약서를 3부 작성하여 각 1부씩 보관하고,
나머지 1부는 비자 신청용으로 제출한다.
Article 18(Signature) In witness whereof, the parties hereto sign the Contract in triplicate on the date entered below with
each party retaining one copy and submitting the third copy to an immigration office for Employee�s visa application.

its not 3.3.....dont sweat it just take it up with the schools accountant....I did and the tax was lowered accordingly....you should only pay 1.5%...show them the monthly withholding tax on the Korean governtment website to calculate your deduction

each pay period.

Strange for a public school job....I was paid on the 25'th of each month for that month.....they shouldnt carry the pay period forward that far!

3. In the event of termination of this Contract pursuant to any of the provision set forth in the foregoing 1, Employee
shall immediately refund the loan to Employer according to Article 7, item 3.
4. If Employee is sentenced to a term of imprisonment (or any other more severe penalty), Employee shall automatically
be dismissed and Employer will not provide any financial compensation.

제15조(손해배상)

Article 15(Indemnity)
1. Employee shall be indemnified against and protect Employer from any liability or damages arising from or in relation
to any negligent, faulty, or illegal activity of Employee during the Term of Employment under this contract.
2. Employer shall check the leased facilities and financial matters arising from the use of them by Employee before the
Term of Employment is completed. If any liability or damages are found, these shall be confirmed in written form by
Employee, who will be indemnified from the security deposit pursuant to the foregoing 1. In the case of the
insufficient security of indemnity pursuant to the foregoing 1, Employer shall demand further compensation. In the
case of protecting Employer from any liability or damages, Employee shall get refunded the whole amount of money
secured in advance before the termination of the contract.

제16조 (사전연수)
1. 피고용자는 제3조에서 명시된 고용개시일 직전 (주)웅진씽크빅에서 실시하는 WEST를 이수하여야 한다.
Article 16 (Attending the training program)
1. Employee shall complete WEST(Woongjin English Star Teacher Training) conducted by Woongjin Thinkbig Co., Ltd.
immediately before the commencement of the Term of Employment provided under Article 3 hereof.
Article 17 (Governing Law, Language and Venue)
1. The terms of this contract and the rights and obligation of the parties hereto shall be construed, interpreted and
determined in accordance with the laws of the Republic of Korea.
2. The Governing language of the contract shall be English & Korean. The translations of both are the same.
3. If a dispute or disagreement should arise in connection with or out of this Contract, the parties hereto shall first try to
resolve it in accordance with a principle of good faith. However, if the parties fail to mutually resolve such disputes
or disagreements or come to amicable settlements, their disputes or disagreements shall be finally resolved by
arbitration of the Korean Commercial Arbitration Board.
제18조(서명) 고용자와 피고용자는 본 계약서 말미에 기재된 날짜에 본 건 계약서를 3부 작성하여 각 1부씩 보관하고,
나머지 1부는 비자 신청용으로 제출한다.
Article 18(Signature) In witness whereof, the parties hereto sign the Contract in triplicate on the date entered below with
each party retaining one copy and submitting the third copy to an immigration office for Employee�s visa application.


Are you sure this is a public school job? It looks more like a uniwon or something along those lines!

Public school jobs usually offer 15 days sick leave
300,000 won settlement bonus
no mention of campus housing
pay during the month worked
something smells fishy here

I'm with Mr. Grotto here. Something doesn't look right.

Looks like a hakwon or uniwon job that's just taken the worst parts of the public school contract and left out the best parts. I've never heard of elementary kids giving an online video presentation.

Nor I have I heard of make-up classes for public school...that's a hakwon trick.

30 hours a week? Strange for an elementary school. It's 22 for GEPIK.

I'd ask the recruiter to take me to see this school, because it does NOT sound like an elementary school at all, more like a hakwon.

I'd pass on this one.

AHA!!! I thought so! Public schools DON'T have classes during SCHOOL vacations. Your recruiter is LYING through his or her teeth. Point this out to said recruiter. I'd like to see them wiggle out of this one.

just to ad to the points made by Grotto

-public school jobs offer 14 days vacation
-you should be able to carry over 5 days vacation from one contract year to the next.
-you get an extra 6 working days off for the subsequent year.

that's what my public school contract states. I like your working hours though. I have to be here from 9-5.

This looks like one of Korea's private elementary schools. It is not a hogwan. Hogwans usually do not have sports days. You should talk to some other teachers who work there.

No mention of pension, but this could be good for you if you're British.

The contract doesn't state that holidays are paid nor how overtime is computed. Many schools pay overtime based on hours worked so that you pay for your own holidays. Many teachers are unaware that this is happening to them because they don't do the math.


It could be a good job. BUT: Talk to other teachers FIRST.
