The case in question that caused the warnings came about because the coffee was SO HOT that it actually weakened the cup on the bottom and the hot coffee cae out the bootom of the cup and scalded the ladies legs QUITE BADLY.
It was not some stupid lady that spilled hot coffee.
As is the stupidity of the legal justice system the answer was to put warnings on the coffe saying that (DUH) the contents are hot.
The lady was also awarded a settlement because it wasnt her stupidity that caused the accident. |
Sorry this is not in line with the intent of this thread, but I can never resist opining when this example comes up. and Hamlet712 is absolutely right.
But what's most amazing about this matter is how so many people use it as a example of greed & idiocy on the lady's part (a Ms. Stella Liebeck), when it truth it is an example of greed & idiocy on McDonald's part.
The facts; Ms. Liebeck received 2nd and 3rd degree burns on her legs and thighs when her cup leaked searingly hot coffee on her. (as I recall, Mickey D used to keep it at 185f.
She contacted Mickey and requested they pay her medical bills (about U$300).
They refused and dismissed her as a befuddled old lady.
Offended and insulted, she contacted a lawyer who argued the case, and won her several million U$$$$$ awarded by sympathetic jury.
Upon appeal, the amount was substantially reduced, but was still significant. Mickey was also ordered to post a warning on their hot cups...AND reduce the holding temperature according to recommendations by experts.
The most significant issue in this is Mickey'd had numerous previous complaints about the temperature of their coffee, and ignored them.
And it took a little old lady to bring them down a few notches, and drain off a little bit from their deep pockets.
Is there anyone here who wouldn't have done that too?
I know that I would have.
Oh and yes - c'mon...the laptop was bought for parts. Get over it. |

| I hate to bump this stupid thread, but I just want to add that I just bought something (the digital picture frame) from paulandamy without issue. I wired her the money in advance, and she subsequently shipped it to me. It was in perfect condition and exactly as described. |

Right, it was a case of a stupid lady letting others think for her. Do you avoid wearing a seatbelt because you know you are good driver? Even if a drunk driver crashes into you and your car, wearing a seatbelt can still save you.
Is drinking and driving the same as giving someone hot coffee? No. She knew what she was getting into and didn't take steps to prevent hot coffee from getting on her.

No, it was a jury that came to a verdict not the judge. The jury is supposed to represent the masses, not misrepresent them. This jury didn't find her greedy or idiotic, nor did they look at the facts. They simply saw a chance to give a win to the little guy/gal. |

I agree. I've often suspected "jackdaniels" of being a sock, but who knows? People definitely need to be careful who they deal with on the Internet, in any case. |
I've dealt with jackdaniels before and found him to be reasonable and honest... I'd definetly deal with him again in the future... its a shame that this wasn't resolved via pm's or a phone call... |

I am the first to admit when I am wrong, and apprently I am.
I have a memory of being told that the general perception of the case was wrong and that the cup actually came apart. So far I have read nothing to support that.
HOWEVER, after taking the time to read the case facts on the net, the fact that the coffee was SO FAHKING HOT as to cause 3rd degree burns is still the case. McDonalds produced its own internal documents to show that they knew it, they were aware of it, they had previous issues of a similar regard and the continued to serve the coffee that hot claiming that " most people order it to drink it at work.
Listen, if youre going to sell cofee out of a drive thru, you cant really expect that people are NOT going to spill cofee on themselves in their car, or ANYWHERE. Ive spilled hot liquids on me before, but since they were about 130 or 140 like they are supposed to be, it hurt, but it went away.
When Coffee is held near the 200 degree mark, then thats simply a reckless thing to do. |
