Unfortunately, the Conventions DON'T address this situation. By their own standards they aren't soldiers, nor are they civilians. They don't fit into either camp by either definition, although I understand the argument that they should be considered soldiers.
At the same time, if they want the protections afforded by the Geneva Conventions, all they have to do is get a "fixed, distinctive sign recognizable at a distance" and "conduct their operations in accordance with the laws and customs of war." Those are the tripping points for them. They are hiding amongst the civilian population, laying booby traps that maim and kill not only their enemy but innocents as well.
The only way I can see this getting resolved is if another convention is called and this situation is addressed by either putting them into soldier/civilian camp or by creating a new category for them. However, as evidenced by the actions of governments since the end of WW2, I'd say there is a reason that they haven't already been classified one way or the other (see France; re: Algeria, Russia; re: Chechnya, Latin America; re: Contras, revolution, North Korea; re:North Korea).
Of course, writing one's Congressman and demanding accountability and higher standards than the conventions require (either in reality or as we'd like to interpret them) is probably the best way to get action. Which doesn't really give much hope or comfort, does it? |

You're right. Governments wouldn't want the conventions applied to internal uprisings.
I would write if I thought that it would make a difference, but I know it wouldn't.  |

I could only endure a few seconds of the video referenced in the memo below. Watching it without the sound is cheating.

The Genital Mutilation of Children Is Torture is being addressed by NOCIRC, The Ashley Montagu Campaign Against the Torture and Mutilation of Children and the Institute of Humanistic Science at the 2009 Annual Convention of the American Academy of Pediatrics, Exhibit Booth #957, Washington Convention Center, October 16-20, 2009 with handouts that calls for the Obama administration to declare the Genital Mutilation of Children an act or torture that is in violation of the Universal Declaration of Human Rights; the United Nations Convention on the Rights of The Child; the U.S. Constitution and other U.S. Laws including protection of children from child abuse and sexual assault.
Your personal support for these Petitions and, in particular, The Ashley Montagu Resolution To End the Genital Mutilation of Children Worldwide: A Petition To The World Court, the Hague, which affirms that the genital mutilation of children is a violation of the United Nations Universal Declaration of Human Rights; the United Nations Convention on the Rights of the Child; and other international covenants is requested. In my letter to Attorney General Eric Holder, Jr, an injunction against circumcision of male children that calls for the forceable removal of healthy penile tissue was requested and which is consistent with the principles of PL 104-208 (Female Genital Mutilation Act) under the 14th Amendment which assures �equal protection of the laws�; and Judge Flaherty�s OPINION that �Forceable extraction of living body tissue causes revulsion to the judicial mind� should be emphasized in your letters.

It should be emphasized that a major theme of the 2009 AAP convention: Pediatrics for the 21st Century (Peds 21): Fostering Healthy Futures cannot become a reality with the continuing genital mutilation of children.
