The agent is correct in saying that pension is a waste of your money if you're not from North America. I'm scottish too, so I'm glad my hagwon doesn't deduct pension and it's otherwise a pretty ideal position - they do however give me health insurance so I'm pretty sure the two are not intwined.

Edit: But yeah in answer to your question - it is illegal.
