Verify you are in the right (get your balances in writing from the NPS, bank, etc.) then go to the labor board. Sorry you are going though this.

Well I have a whole other set of problems now. I didn't get my severance and the worst part is they haven't paid me my last payment. They gave me the paper that says they did, and they didn't. I needed that money for my deposit and my boss promised me i would have it on my last day. If it wasn't for my friend k would be homeless right now. It's coming on 5 days later and I still haven't gotten paid for my last month of work.

That sucks, man. My sympathies.

I recommend that you dual track this ... which means that you negotiate at the same time that you assert your legal rights. This is not only a good idea, but doing both at once will make you feel more secure as you negotiate, and it will make you feel more optimistic as you file a claim.

One the one hand, be very nice to your boss and persistent in your requests for payment. This approach is as good as any:

Well, use your best judgement but if ot was me I'd march on down there and I wouldnt leave until I had been paid. But, I wouldnt accuse them of anything. I'd be all like "I am so worried that the bank made a mistake! I havent been sleeping it is so stressfull. I have no money for food. The bank said you should call. I know your busy but this is very important. Blah lah blah"

Save the fighting words for when your sure they will be needed

On the other hand, go ahead and begin the legal processes to assert your claim and preserve your complaints.

Some good advice.
