I think you are right on the money. Lets not forget that in days gone by there were a handful of lynchings of black men that got white women pregnant. The women claimed it was rape because it would be obvious that she had been with a black man when the child was born.

Also, if the boyfriend was a witness to it, why didnt he say something at the time?

Whether she was conscious or not, I think it's in poor taste for shakuhachi to bang his wife's sister in front of her boyfriend. Can we all agree on that at least?

But really, honestly, I don't think you did anything wrong. If she wasn't mad at you the next day, then so goes it. squat toilet - ok, so maybe you are right. after all, both sides agree that she was incapacitated during sex. you're saying that she pressed charges because her boyfriend saw. well maybe, but i think her incapacity not only allowed the man to assault her, but shows that without the boyfriend observing, she wouldn't have known of the assault at all.
i suppose that you imply that not only was she complicit and consented, but she was unaware of the audience and then, and only then, she decided to make a case.
but like i said, if both prosecution and defence accept her 'incapacitation' (which means she had no capacity to make a choice because of her drunken state), then there is a real possiblility that she had no recollection of the assault either.
shakakuchi, in answer to your questions
1. How is someone to determine consent when they seem completely normal? both prosecution and defence accepted she was incapacitated by drink, which is different to just 'drunk'.
2. does any amount of alcohol drinking mean that a woman cannot give consent? no, not necessarily. but if you are incapacitated then i don't see how you can consent to anything, given that you have no capacity to decide.
3. What about a man? see no.3.
i think the general implication is that the woman was complicit with the boyfriend and only pressed charges after learning that the boyfriend had seen it.
but the key phrase for me, and you know it cos i kept typing it, is 'incapacitated by drink', or 'incapacitation'. she had no capacity at that point to give, or not to give, her consent to sex and therefore he assaulted her.
p.s. shakakuchi - can you post some more stories about how the legend is continuing please?

I guess the end justifies the means in the frat-boy rule book that some Dave's posters use to govern their behavior. My question is: "Why would anyone want to associate with someone who thought like that?" Then again, the drunk dude approach to life has an insistent absence of soul. Choose your friends carefully. So many Brag-hards on a prolonged binge drinking sexual adventure in Asia. Maybe they treat their sisters the same way? I do hope that these types feel shunned and disdained by the Korean people.

Well, shunned by all of them that are not busy banging their wives' sisters, right?
