AFTER you are married (proof of marriage required) then he (on an E2) can sponsor his dependent family (you) on an F3.

Thanks ttompatz! do you know what documents are needed for this? is it just standard marriage certificate, birth certificate etc? my criminal background shouldn't affect this at all, right? |

Just to make it as clear as possible: I won't be able to apply for an F-3 visa the same time my wife applies for an E-2 visa using the visa issuance number her employer has provided, correct? It'll be only after she has received her ARC and the certificate of employment that I can apply for the F-3 visa, right?
So, what if I come to Korea with her on a tourist visa and apply for the F-3 there after she receives everything we need? We really don't want to be separated, besides, since I am a Russian Federation citizen I'll be able to travel to Korea for up to 60 days without even having to get a visa, because of this recent agreement between our countries. I wonder, what kind of status would I have during those 60 days and if it's possible to get my F-3 there with that kind of status. Any help would be much appreciated, thank you all! |

Okay, all this stuff is old, and I'm not really understanding the information provided.
I am married to a Filipino, and we are currently in the USA. I am about to start collecting documents such as the FBI background check as well as apostillating my degrees and whatnot in hopes that I may eventually be able to go back to South Korea and teach.
Will a dependent spouse also need a FBI background check to apply for a spouse visa? Is he not allowed to apply for a dependent spouse visa at the same time I apply for my E-2? I was reeeeally hoping to travel together. (I don't have any job offers; just putting my feelers out again). Basically, I'm starting to get my stuff together, so if he needs the same thing, I'll get those started at the same time. |

For HER visa you need proof of family relationship (marriage certificate) and a valid visa for you (E2).
She does NOT need anything certified or any background checks.

I've spoken with Korean immigration here in Korea and they said that a spouse can come to Korea on a tourist visa and during the 90 day period (for Americans) you can apply for the F3 visa. I'm doing that for my future spouse after we get married next year. |

Hi all, I'm not sure if this is the right place to post this, but I hope someone here may have some info. I'm having trouble finding out whether there will be any problems for a legally married same-sex couple to get an F3 visa. The odd thing is that my girlfriend is transgender and I need to make sure that there will be no problems with immigration based on how she dresses/presents. So as far as Korean immigration will be concerned, we'll be a legally married m/f couple, and I figure that as long as all our documents match, there should be no problem and how we dress shouldn't matter, right?
Well, I got up the nerve and called immigration. It's a nope on F3 visa for a same sex couple--as I thought. Oh well... |
