Well, that is one interesting thing about immunity--- your OWN government has to accept your claim of immunity. You can go running to them, request to invoke your immne status, and the request can be denied. Your government can choose to hand you over to the local courts if it wants. I guess a more accurate way of describing the legal status of soldiers is that they are all POTENTIALLY immune to local prosecution. In the case of the traffic accident, the government chose to give the soldiers immunity because they felt they would not receive a fair trial in the Korean courts. They also have a blanket policy of giving immunity to soldiers who get caught teaching private English lessons for cash, interestingly enough.

If they are off duty at the time of the alleged crime then they are liable to local prosecution no matter what. If they were on duty at the time then it is USFK's discretion to turn them over or not, and from what I've heard many Korean prosecutors prefer it that way and even often give up their jurisdiction -- they don't want extra work on their plates if they can shove it off on someone else, and like others have said the UCMJ can often prescribe harsher penalties.

Interestingly Korean soldiers in Afghanistan are completely immune from local prosecution, much like US soldiers used to be in Korea. One of those things that makes you go, hmmm.
