Even as an American I have to admit that is pretty detestable and something needs to be done to change this crap. It's flat out smug and cold blooded.

It's quite true. If you even get arrested and have the charge dismissed, you can still have that charge show up on your FBI check. And those things stay on your record for life. If you go one country north, the laws are different. You can get busted with a bunch of weed, get the charge dismissed, and come out with a clean CBC.

You can have arrests on your record but still be granted an E-2 visa. The arrest might not say much other than the offense itself or it might include a "dismissed." If it(CRC) doesn't show anything, then another document could be requested by Immigration, maybe just a simple something the court could e-mail you saying said matter is "dismissed without prejudice" or whatever as long as it somehow matches what the CRC says.

If you haven't ever taught in S. Korea before then who knows, maybe things would be different? I'd be surprised if most recruiters are automatically denying all possible recruits that have misdemeanor/felony arrests. A felony arrest doesn't automatically disqualify you as long as you weren't ever found guilty. But yes, Americans are probably getting the short end of the stick and there could be less of them teaching Eng. in S. Korea as a result since a "clean record" or blank record is likely the ideal for hagwons.

The US also has the highest incarceration rate in the world and the largest prison population (well, if you ignore prison states like North Korea).
