Seems that they'll assess the circumstances and decide what sort of punishment would fit - you say she's got no money so she'll be unable to "leave Korea voluntarily with her own expenses", so if she were to present herself at immigration then she'd be detained until such expenses can be acquired.
She'll not be detained for "50 years" as they have a limit on detention:

I would imagine that if no payment of either airfare out the country or settlement of fines is forthcoming, then as Gord says the South Korean government would contact your friend's government to collect the money and pass the problem onto them.
The longer she stays here the worse it's going to get. |

You guys are all so full of crap....I personally know of one guy that tried to leave the country on a 6 month visa overstay and all they made him do was wash a whole bunch of dishes in their kitchen....oh wait a minute, maybe I'm confused with not having enough money to pay a bill at a restaurant.
Seriously, Kris. As Homer mentioned, you come to the board to ask for advice, and the advice was not to your liking and you fault the board for it and blame Korea for being corrupt and everyone else is breaking laws, blah, blah.
At what point will your arm get tired of pointing the finger elsewhere and recognize the catalyst of your and/or her dilemma? Don't fault others for not telling the news that you wanted to hear. A simple thanks for the heads up would be more appropriate. |

worst comes to worst, she will have to pay something. get some money together, get her out of the country, NOW. lend her money, give her money, send her to osaka, whatever, but clear the debt ASAP. then she can try to re-enter on a tourist visa or something. plane tickets aren't that expensive and she can stay in a hostel somewhere. there's no easy way around it- she/you will have to suck it up and pay. though there is the chance that once she's out, she wont be let back in.
she should have thought about this a few months ago and checked out the immigration office and embassy. |

This assumes that she/he is able to get another visa. Immigration may decide since they broke the last visa by 6 months it is far too risky to allow another visa. Also a lot of countries will do a cross reference on stuff liket this so you might not be allowed in other countries I know australia does but I am sure there are others. |

where did you get this from? The only country where I HAVEN'T gone through immigration on the way out is the US. Thailand, China, Hong Kong and Indonesia all make you go through immigration on the way out. |

Well seeing as you mentioned Japan, I thought I'd share what happened to a group of 8 Ethiopians I used to know there. On the way back from a picnic, the police pulled them over and asked for their foreign ID. They had none as they were all there illegally having overstayed their tourist visas.
All were arrested and all deported within 4 days except one man who, for some reason I'm not sure of, who remained in a concrete cell at a deportation centre for about 2 weeks only being allowed one visitor a day and no written communication. Then, he too was deported.
How much money exchanged hands I don't know but I'm sure some did as they were undoubtedly fined. They never got to return to their homes and even draw the curtains or change their clothes. Lord knows what happened to all their stuff.
Faced with that kind of situation, other foreigners I knew there who had overstayed decided to approach immigration about a month before their scheduled departure. It was tough but in every case, they were allowed to leave after having paid a fine.
Take the advice, go and tell someone official what the situation is. Don't just turn up at the airport. |
