Did I miss why the teacher is unable to work in the mean time?
If they are held here without resources, can they not appeal to the Human Rights commitee? |

It's not my situation...so I don't know the full details...only hearing it now first hand from the teacher. She will be posting details once this is over....right now...she does not want to mention her name or the schools.
She did NOT receive a termination letter. It was verbal. Wangja gave her 30 days notice. Again, nothing in writing. Teacher goes to the LB the day after wangja told her she was fired. LB says she has no case until she is done working...then she can file a claim. She was still employed at the time.
Reason for termination...unclear to me. But it's about vacation. Teacher had 10 days coming.... Wangja gave her one vacation day...she needed two days and took both days with the KT's approval...KT's told wangja that they had no problem with her vacation and the three other FT's also had no issue with her vacation....classes were covered. Came back from vacation...wangja tells her...you are fired...I don't accept your reason for vacation....you took 2 days...I gave you one day.
She asked for a letter in writing stating the reason....none given.
Now my thinking is this...wangja can always tell the LB that a letter was given....wangja's word against the teacher's. Anyway...the teacher lost her case at the LB hearing. Wangja countersues the teacher for quiting.....using the LB's ruling against the teacher.
Why can't she work in the mean time....because the issue is not resolved...she is still under the schools E2...no release letter given.
It's all about revenge...wangja is angry that the FT is standing up to him and had the nerve to file a complaint.
But...what gets me is this.....it takes a high ranking immigration officer's signature to block a foreigner from leaving....why can't these idiots see through the issues?! It's just about revenge from wangja. |

Edit: but being dismissed does demand something in writing. If she then resigned in writing, her position that she was unjustly fired is weak, unless she has witnesses. |

Thank you for correcting my poor use of the language...I always thought it was spelt the way I have been! Wonjang it is!
What does "wangja" mean? |

The whole thing sounds very strange. Has she consulted a lawyer? I've never heard of someone being prohibitted from leaving a country because of a civil suit. If so, it's certainly a gun an employer can put to a foreign employee's head. If they actually fired her, they have to terminate her contract and have immigration give her a 14-day exit order. If they haven't done this, she's still their employee.
She really needs to consult a professional. Has she tried Marc the extremely helpful lawyer on ES? |

I thougth that it was already rejected by the labour board.. if so, then they decided she quit. Could that not negate her E2?
EDIT: I just saw this. Silly me, I forget the rules of an E2 sometimes.

Has she tried to leave��yet?
Unless she is willing to fight this thing out, which it sounds like she can't really afford to do.
If I were her, I would conveniently, suddenly, but accidentally on purpose happen to lose her passport. Get a new one and she's outta here.
I don't know if that plan would allow her to get another job here, but I think it might.
I've been told, they track passports by number, not by name.  |

I have not heard from her or my other friend for a few days now...so I don't know the current situation...but...lost passport? Would not work. One needs a police report for the embassy and another is...time. It would not be issued in one day or even 2 or 3...or...
Tracking only by number? Don't know...but I think the immigration computers also track by name as well...not just numbers.
In any event......she's stuck until the matter is resolved. She is still under the schools visa...it has not been canceled.... |

I suppose it depends where she's from and what that country's rules are regarding a lost or stolen passport. But I wouldn't entirely discount this option if she can't leave the country anyway, what's a week here or there?
All she has to do is say someone picked her pocket.
I still really can't see them not allowing her to leave if she wants to. If it's a civil matter, it really should have nothing to do with immigration.
Prevent her from working elsewhere, sure, but I do think she should try to take a ferry to Japan and see what happens. |
