| I have taught for two years in Korea and now I am in a strange situation. After 5 months,I was told by my school that I am being laid off. They said they only need 9 foreign teachers and not 10, so I am the one to go. My boss is paying my way back to the states. When I asked for a release letter he said he will give me a letter of recommendation but he sid I don't need a release letter until I find a new school, which I will be doing when I am back in the states. He has not said anything about me going to immigration to cancel my current visa either. Do I just hand in my alien card at the airport and have them stamp my visa in my passport USED? I am a little bit confused here. |

Unless you did something wrong, he cant just do that. Labor office, say the magic word. Anyway, he must give you a months paid notice.

This is true. You need to find a new employer first. But get the recommendation letter now, he might decide to screw you if your future employer decides to do a background check.

I think he needs to take you to immigration to cancel your visa, then you have a number of days to leave the country and you hand in your E2 when you leave. I dont think it really matters that much your end, but it is quite important for him and his relationship with immigration. Not sure ~ anyone? |

A person working at a place for less than six months does not enjoy a "cannot be fired without notice" perk. There is no legal protection. At best, it's a strictly civil issue that can either be solved between the employer and employee, or a civil court as it is a contractal issue and nothing more.
He doesn't even have to pay for a return ticket, but he's being nice and giving both notice and a return ticket. |

Sure they do, if they have the foresight to have it added into the contract. Based on Princess' past posts, that's probably not the case, however.  |

I did in fact already address that. Even if one does put it into the contract, the labour board cannot legally force a school to comply with their contractual agreements any more than we can. They labour board is more of a non-binding arbitrator than a court, and as such can no more than suggest what an employer and employee do. |

Why are you the 10th isn't there a teacher with less seniority and talent than you? Is your boss some kind of donkey or something?
Won't it be horrible being surrounded by those fugly American while you're back home? |

True, but as many of us (and you) know, the labor board is in fact only a first step in the process (although disputes often end with them, mercifully). |
