E2 extension ... but not to work

Hello there,

My contract will end on the 31st October. However, due to my school's slackness in sending me on my visa run when I first arrived, my E2 won't expire until mid December.

Can I legally stay in Korea on my E2 until this date, just to travel or sponge off friends? If so, ideally I would like to stay until just before Christmas, so could I get a cheeky extension through the G24 (or GF4, whatever it is) website?

this is actualy a good question - i think it depends on what your school does when your contract ends - allegedly they should be notifying immigration, you should be issued an exit order and then you leave on or before the date of the exit order - this is irregardless of when your visa actually expires. it would be the same if you were fired, for instance. the school is always supposed to notify immi regarding a change in status of a foreign employee.

i think a lot depends on your school and how efficient they are with this kind of matter. i wouldn't try and second-guess them; what you can do is not say anything, finish up and then go down to immi a couple of weeks after you've left and ask about the status of your visa. i did this once when a school closed thinking i would have to leave (my visa then was only 3 months old) and immi told me no exit order had been issued just go find another job and i was fine.

another time a school received notification my visa was almost expired even tho i didn't work there any more and my visa had been officially changed to a different school - but the point was, immi notified someone about the approaching expiration date.

i think you should keep mum about it but chances are good the school will ask for your ARC in which case that means you will be getting your visa canceled.

I thought that you had to hand your ARC in to immigration at the airport?? I found this out the hard way last time I left Korea - I'd lost it and I had to pay a fine.

I was kind of thinking along the same lines as you re: school efficiency. They're not the most efficient bunch but they generally do like to do things by the book. We've talked about a few end of contract issues but this hasn't been mentioned and I don't want to bring it to their attention.

If you extend while you are on your E2 you are still tied to your employer and he is still responsible as your sponsor. If he (as required by immigration law) reports the termination of your employment you have 2 weeks to leave the country - even if you do NOT know about it. Why risk it?

Save yourself the grief.

After you finish your contract, take a weekend trip out of the country, hand in your ARC on the way out and get a new B1 stamp when you come back. You can find a cheap trip to Taiwan or catch the ferry to Japan (both run about 200k won).

If you are Canadian you get a 6 month B2 stamp and have no worries until you are ready to start work again.

If you are American you get a 30 day B1 stamp on arrival and you can extend that to 90 days by dropping into the nearest immigration office and paying for a C3 tourist visa. (You can also get a C3 visa when you are out of the country and save the trip later. It is a simple matter of making the application and paying the fee at the Korean consulate).

If you are anyone else (who qualifies for an E2) you get 90 days on your arrival back in Korea. Enjoy the winter and make your visa run for your new E2 when you are ready.
