I've just been browsing the EFL law board and the Ministry of Labor board and I am still confused.
What percentage of my wage in tax should I be paying?
What percentage of my wage goes to pension contributions?
If my contract makes no mention of sev' pay, is the school still obliged to pay it?
Some of the answers on the Q and A board state that severence pay is only paid in accordance with the contractual agreement between employee and employer. In the past however, I have heard that one month's pay MUST be given for each 12 months worked, no matter what the contract says. Surely the Min' of Labor answerer person hasn't got it wrong??
If I quit midway through a second or third contract should I still receive my severence?
If anyone can shed light on these problems it would be much appreciated, especially if you can provide a supporting quote or website that I can't seem to find for myself.
(ps FYI I have paid 20% of my gross pay in taxes this year) |

It depends on what your salary is. Did you see the taxation scale on EFL-Law?

Somebody correct me if I'm wrong, but I think it's 4.5%

Even if it's not in your contract, your employer IS obliged to pay severance.

Yes, your severance is pro rata for each month after 12 months. So if you've worked for 2 years and 2 months, you are entitled to the equivalent of your monthly pay (x2) and then a bit extra... don't know how to calculate the extra amount.

Oooh! That sounds like a lot!!!
http://www.molab.go.kr/English/abou/sub_3_2.jsp Here is a list of contact numbers for various Ministry of Labor offices around the country
Here's a website about getting your severance if you're having trouble with your employer.

For this, an employer must have a minimum number of employees already on hand. |

I believe the minimum number of employees is 5. |

Does anyone know if the same rules apply for the national pension scheme? |

Your school may claim that this severance pay is included in your hourly wage.
That's what Berlitz Korea does with its instructors and pretty much gets away with it. |

as for your taxes (I've put this up a few times before, but can't find the thread):
All ANYONE has to do is to take their ID card to a local taxation office (a Korean friend would be helpful as well), and ask for a copy of your taxes paid to date. You may need some basic employer info as well (school name & addy).
They will give you a form showing what the employer says you are making, and what they are subsequently paying in taxes.
Make several copies of that yourself, then confront your employer. No hak-won owner wants to deal with a full-blown tax investigation - about 3 years ago, a bunch of the bigger chains lost franchises for just that.
Good luck, & keep us informed!
Regards,
G. |
