|
|
I know that this has been done to death on this board, but all my attempts at doing a search have resulted with the page locking up.
I'm in my second year contract with the same place and wish to quit and find another job. If I give the 30 days, min, notice that law stipulates, is there any way that the boss can refuse to give me a letter of release? I'm interested in the legalities of it, and whether or not an employer must release an employee if due and sufficent notice has been given.
Regards in advance. |

yes, he can. it's entirely up to whether or not he feels like doing it. there is no legal obligation to give a letter of release. |

You also do NOT NEED a letter of release IF you get your visa canceled. |

I was under the impression that the only way to get your visa cancelled was to get fired, or closure of the company! |

some people have reported that when they went through the immigration at the airport, they asked for their visa to be cancelled, and the airport ppl did it no problem
edit: but if the airport ppl don't do that, then u need a LoR to get another job in Korea (without waiting for your visa to expire) |

If you're on an E2 visa there are 4 ways you can get a new job:
1) Get your employer to accompany you to immigration and cancel your visa.
2) Have your employer sign and stamp a Letter of Release, which you later take to immigration to cancel your visa
3) Get your visa transferred to a new place of employment - in this case both your new and old employers must be willing to cooperate and send the appropriate paperwork to immigration.
4) Leave the country and wait until your visa expires at the end of current contract, at which point you can apply for a new E2 visa. |

5. Cancel your visa yourself at the airport. |

Is this just heresay or do people know that this is a valid method, that is guaranteed. I'm on an E-7, but assuming that the would be no difference in this matter. But then again assumptions are dangerous |

Anybody can comment on what you can do if you have an F-Visa? I'm about to get one very soon (i.e. this month) and the missus and I are thinking of leaving early and starting up again in March.

I did this in May. I had multi-entry E2 visa. No LOR.
"Here is my ARC. Please cancel my visa."
"OK." |

And how long afterwards did you have your new visa? |

The next morning. Maybe that afternoon. I don't know, whenever they pasted it in my passport.
I entered the day after I left with the new E2 visa.
I have told this story more than once. I'm not sure why people so disbelieve me. I was friendly with the official. I wore nice clothing. I spoke clearly and simply.
I have no reason to post BS stories on ESL cafe.
I did it in May. Handed over the ARC. "Please cancel my visa."
"OK."
Done. |

If your leaving the country, and not the wedding reception, then I think you have to get a multi-entry visa at Immi.
Not sure of the cost, although I remember someone saying 60K.
EDIT; If you are talking about leaving your job, which just dawned on me, then I don't think there is any problem. If you are on an E2 visa now, then I am sure that will get ancelled when you get your F2. |
