Hey guys, I need some help. I came here for a job with an E2 VISA. The job didn't work out, when I quit they said they were cancelling my VISA and would give me a Letter of Release if I wanted one but they had never heard of it before (I came here and quit during the training for this job, so before teaching began and before I signed the ful contract... long story. )
Anyway, they lied to me and didn't cancel my E2 VISA. I checked it at the immigration office and everything and its all good. Anyway, I've been working for a new company here for almost 2 months and i'm nearing the 90 day requirement for getting my ARC card and I have a few questions.
1. I've read that to get an ARC card with an E2 VISA I have to have the business' registration number along some other job specific info... info that I don't have and won't be able to get. Is this true?
2. I've also read that if I don't get my ARC card within 90 days then my current E2 VISA becomes invalid and i'm subject to big big fines. Is this true?
3. Also, assuming I don't get this card and have to leave then I think i'll come back on a tourist visa, work for a few more months saving money, and then get the hell outta here. How risky is this option? What do you guys recommend I do if I can't get my ARC?
Please help me out guys, so far teaching in Korea has been a pretty stressful thing and I just want to get all this immigration stuff settled. Ugh.. please help me.

First, you have to realize you are working illegally and regardless of what you do, you are likely to be required to pay some type of fine. YOur E2 VISA belongs to your former employeer. Working for another company is illegal without having permission and having the new employeer added to your E2. However, that is not an option because you quit your first job. So, basicly you are probably looking at a fine of some sort.
IMHO you should get your old boss and take him to immi and get your E2 canceled. Then negotiate with your current boss -- the one who hired you illegally and could also get fined -- and ask him to fill out the required documents to sponsor your next E2 VISA.
So, to sum it up, you have 2 options..
1. (The best of the two IMHO) Go get your old boss and take him to immi and get the VISA canceled. However, after doing that, you will have to apply for a new E2 and will not legally be able to work until you get it, and you will have to leave the country.
2. Go tell immigration the truth. Take your new boss with you. Outcome.. probably the same, plus some fine for working illegally.
Option 3. Work on a tourist VISA. Illegal. AND with all the crap that immi is making E2 holders go through, if you do decide to work on a tourist VISA, don't tell anyone or you will likely get your a*s*s kicked. It is people like you that immi is trying to get rid of.
Get legal or go home.
In short Spuddyj, everyone is telling you the exact same thing I told you from the get go, but which you chose to ignore. Ok, so I may have been a little off base with the kick your a*s*s thing, but the advice I gave you was correct.
I have also heard that the C4 VISA is just as difficult to get as the E2, so you may as well just go through the E2 process and get it over with.

Let me guess, you would be one of those people who would kick my a*s*s? Because people like me are the cause of all these immigration problems, yes of course, because you know everything about my situation and can summarily pass judgment on me. Because of course I am not now poor as f*ck and worried about being able to pay for a plane ticket back, and I didn't have to borrow money to feed myself while I tried to sort out this messed up situation. And I cna simply fly home with no worries...
Anyway, thanks for the info though. And sorry if I misinterpreted your post (and I really am if that is the case) but you sound like you got a bug up your ass... I know I sure as h*e*ll do. |

haha, go right ahead. I actually think that bug has made himself quite a nice home up there too cause he's been there for awhile 
But yeah, sorry if I let it get to me. And does anyone know if I actually can come back on a tourist VISA after leaving with an E2? Someone told me today that I can only get that 6 month tourist VISA if I come from Canada and that otherwise its 1 month only. Is that true?
And if I do take the tourist VISA option then i'm just staying until I recover the money I spent to get here and what i'll need to leave and then Im gone.

Just as long as you realise that this does not make what you are proposing to do any more right. It is still not legal ... and people who do this are the people who contribute towards giving all of us a bad reputation ... And if you are caught ... you are likely to both get a large fine which you will need to pay before you can leave the country ... and then deported from the country ... I would seriously suggest that you consider the possible impact on YOU of what you are considering ... before doing something that you may live to regret ... |

No I am not saying this because I am one who would try to kick your a*s*s, but to emphasis that you are the kind of person that those of us who have been here a while wish would go away. You post on a public forum that you want to break the law to "recover" your money, and you want the rest of us to help you by telling you it's OK? I'm sorry for your troubles, but breaking the law, and making it harder on those of us who are trying to do the right thing by complying with these stupid set of new rules that immi just announced, just isn't right.
As I said before, get it legal or go home. If you don't have money for a plane ticket, talk to your embassy, explain the situation and they will help you get a ticket. BUT DON'T BE A DUMB A*S*S AND BREAK THE LAW!!!! |

Hmmm, tricky.... How did this work out? Did you quit your first job within your first month of working there or something?
I won't condone working illegally, but I can sympathize with being in a tough spot. By the sounds of it, you want to do it legally, but your previous employer screwed you over. So, how to make it all legal again?
As a previous poster has stated, the only legal way is to get your previous employer to officially cancel your current E2 visa. The only way to do this is to physically go to immigration WITH your previous employer. The boss-man has to be with you to sign some papers, this is important. I had to cancel my visa just a little while ago, and this is what I was told I had to do (by multiple immigration officers--I called a gazillion times for confirmation). They will then give you 30 days to leave the country, during which your new employer can apply for a new visa and send you off to Japan for a visa run.
The reason that you have to do this is because you do not own your E2 visa. Your previous employer owns your E2 visa. As a result, you can not get an ARC card stating you work at the new hagwon when your former employer is the one who signed your visa papers. And you can't get the ARC card for your old job either, because I doubt your old boss will submit their business registration number to you, and that wouldn't be legal anyways.
One thing that might be your saving grace: the new E2 laws, effective Dec. 15th, apparently allow for the transferral of E2 visas to other employers. Nobody is really certain on this, but Immigration might be able to answer these questions for you. When is your 90 day window up? If it's still a month awa | | |
