Foreigners' Rights Denied Even After Death
Chosun Ilbo (February 13, 2007)

Quote:
If a man dies, his next of kin should be notified. Why haven't we been notified yet? Are we not human beings?" protested Won Chun-hui, 37, a niece of Lee Tae-bok, 42, a Korean-Chinese detainee who perished in the Sunday morning fire at the Yeosu Immigration Office. "Had we been Koreans, would have you treated us like this?" Won asked at a press conference at the immigration office Monday afternoon....

An Immigration Office official said, "We intended to notify the bereaved families whose addresses are available. But the acute situation Sunday kept us from immediately notifying the next of kin."

Illegal residents as they were, it seems the most basic human rights were denied to the eight Chinese and one Uzbekistani victims even after their deaths.

Were there any repercussions at all? Anyone at immigration at least get a slap on the wrist?
It seems that concept of negligence does not exist here. Unless of course you are an Indian oil tanker Captain who fails to move an oil taker in only a few minutes.

The Korean constitutions grants rights...to citizens. However, there are laws that protect foreigners in Korea (although, it appears the anti-discrimination law has been thrown out the window) and Korean is a signatory of the Universal Declaration of Human Rights. You can sue, file grievances, etc.

Some parts of that Declaration. I am guessing many businesss in Korea pay them no mind.

Article 12.
No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, nor to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.

Article 17.
(1) Everyone has the right to own property alone as well as in association with others.

(2) No one shall be arbitrarily deprived of his property.

Article 24.
Everyone has the right to rest and leisure, including reasonable limitation of working hours and periodic holidays with pay.

Article 25.
(1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.

(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

Just because there are laws doesn't mean those laws are enforced. We all know how Korean "justice" works for non-Koreans. Try suing a Korean in a Korean court and see how far it gets you. I'm not saying it doesn't happen, I'm just saying not to expect the best outcome.
