I was fired from my job last week and last night when my boss called over to my house to give me my last months salary as she wanted me out of
my apartment ASAP. She first tried to tell me that she could only give me 300,000 last night because she said that her computer was broken and she could go online to her bank account to access her money. She then said that if I gave her my bank account details she would transfer my money. I pointed out to her that she already had my details and she plenty of time before then to organize money transfer with or without her computer.
After a bit of further discussion I told her that I would come to her office the next day and give her the key back when I received all money but she didn't want to do to that either. She then points to a piece of paper with 850WON written on it and asked me who was going to pay for my flight over to which my reply was that she fired me and hence I was not responsible for this bill. At this point her husband who was also there became very angry with her and says to her in Korean(my girl friend was there and can speak Korean) that she should not have fired me and that I was very good teacher and only one class had problem with me. So then she then tells me that she can after all go to an ATM to get all the money I'm owed and would be back in a couple of minutes.
From my apartment window I could see her husband push her into their car in rage. Ten minutes later I had all of my money and I was free of that s%^ty school for ever as I had cunningly asked for and got a letter of release signed and stamped my boss the day I given my notice when they were under the mistaken impression that I would be a push over. I am really happy now as I really didn't like that school was ironically enough considering resigning myself but didn't want to because doing so would mean that I would have to buy my way out of my contract.
Also god help the next English teacher when he starts because he during my final week I was extra nice to all my student and had tried to totally spoil them so that all of the kids will complain to their parents that their new teacher is not as nice as their last one and has no games to play because I took back all of mine when I left on Tuesday and I even took every last crayon, color pencil and sticker that I had brought. |

Wait a moment. You said last month's pay but you also only got a week's notice. Where's the 30 days' pay in lieu? |

Well my contract said two weeks notice and I figure that I will have a chat with the labour board once I'm settled into a new job. But to be honest I don't know if I'll be able to get labour board to do much seeing as I had only been teaching 4 months at this school and the labour board often won't even look at your contract if you leave before the six month mark.
I think if I do manage to get another months pay out of my director I think her husband will end up strangling his wife. The husband so pissed at her it was priceless watching them  |

That's nice of the employer. The law requires 30 days notice, not 14.

Different branches look at it differently. I really don't know where the "magic six months" rule came from. I don't think I missed it on reading all the links to the Labor Standards Act here. The Labor Board is supposed to be independently examining the issue, not deciding automatically in the employer's favor because the employer canned you before some mysteriously magic term of enslavement. But you can make the Board's staff do some actual work by filing your complaint. If (when) it's returned to you with no action, then you can either file it again and again or take it to the courts, preferably small claims court.

Hey! Maybe you could recoup some of your losses by selling ticket to that. (For the humor-impaired reading this thread: that's a joke.) I also think it's a good idea to refuse to vacate the apartment just because they canned you (no, that's not a joke). Let them discover the loveliness that is Korea's court system when they go to have you evicted. The police aren't going to just show up and say "move along now" to you on their say-so. They'll need a government document mandating that you, in particular, "move along now."
By the way, also have a chat with a reporter at the Korea Herald about this. They appear to be keeping some kind of database on teachers getting shafted here. |
