a colleague of mine called the proper authorities in California about the Police Check. They told him he had to have a Police Check from his current country of residency, get it translated and notarized and then send it with fingerprints to their office and after that it would take up to 4 months to get.

Also, when he went to the Police Station here, they were very rude and shouting and once they settle down it took them about 2 minutes to produce the check.

i haven't actually gone through the process of getting my background check, but have done some research. according to this california dept of justice, http://ag.ca.gov/fingerprints/security.php , you can mail in your fingerprints for a background check for a visa if you live abroad. but be sure to tell them its for a work visa and that you need it to get apostilled and they will include a cover letter with a original signature and seal of the ca. attorney general which the secretary of state will apostille without a notary. Here is a copy of the email i got.

This is in response to an e-mail you submitted to the Public Inquiry Unit of the Office of the California Attorney General on December 14, 2007. In your e-mail you posed questions on the process of having a criminal background check apostilled.

The California Department of Justice, Bureau of Criminal Identification & Information (BCII), provides background checks pursuant to Penal Code section 11105(c)(Cool, to those individuals who need them in order to enter this or another country. If the result of the background check has to be apostilled, the BCII will provide a letter bearing an original signature and the seal of the Office of the California Attorney General. The California Secretary of State will apostilled this letter without it being notarized or certified as long as the signature and seal are present.
