Folks:
I have a job offer at a College, with the following conditions, but if I accept, I would have to leave my present job one month early, lose my severance pay (2.7 million) + flight (850,000), and create a slightly bad impression for leaving one month early, even though my present employment place has no students at this time.
What do you think?
SERVICE AGREEMENT
THIS AGREEMENT is hereby made between (name) College (hereinafter referred to as the College) and (hereinafter referred to as the Instructor).
1. CONDITIONS OF EMPLOYMENT
The Instructor's work will consist primarily of teaching English to students attending classes at the College. The Instructor is required to have 12~16 hours of basic teaching hours per week. The Instructor shall attend at least 4 days a week, and have at least 2 hours of office hours a day to have student counselling and help their academic activities. In addition to that, the Instructor is obligated to have special teaching during the semester or vacation at the request of the Dean of Academic Affairs, or level coordinator.
2. PERIOD OF EMPLOYMENT:
The term of employment under this Agreement shall be for a period of one(1) academic year from Mar. 1, 2008 to Feb. 28, 2009.
3. RENEWAL OF AGREEMENT:
This Agreement can be renewed for an additional term with the consent of mutual parties 3 months prior to the expiration of this Agreement. When the College doesn't give a notice the renewal plan to the Instructor within the period, the Agreement shall be expired automatically without any renewal of the contract.
4. TERMINATION OF AGREEMENT:
a. This Agreement may terminate upon the occurrence of any of the following events:
(1) When the Instructor expresses his/her intention to resign ahead of the expiration of this contract.
(2) When the Instructor falls short of the standard as a English teacher and cannot perform his/her duties satisfactorily after notice or warning thereof.
(3) When the Instructor gets lecturing evaluation less than 50 points at the end of semester. The lecturing evaluation will be made by students, and in that case, the Instructor may be discharged from school instantly even though during the term.
(4) The contract will be cancelled when the Instructor's identity to be proved illegal(degree forgery or false work experience, etc.) even after sign the contract. All the decisions related with personnel matters will be made by the College Personnel Committee.
b. In case of the absence from duties due to the sickness, accident and other unavoidable circumstances, the Instructor should submit relevant documents or attached papers to get an approval from the College. When the Instructor cannot submit such documents or papers, he/she may have the reduction of salary. And even when the Instructor participates in the school occasions like membership training, and other festivals, he/she should make up for the lectures that were cancelled.
c. The College may terminate this Agreement without any prior notice if the Instructor is found to be in breach of the Agreement. The College has the duty and right to inform the Ministry of Justice of the Republic of Korea of such termination, which may result in the revocation of the Instructor's entry visa.
5. SALARY AND BENEFITS:
a. The Instructor shall be paid his/her salary on the 25th of each month or on the day preceding that if the 25th day is not a working day. This payment is for the services rendered and to be rendered during the month in which the payment is made.
b. The Instructor is required to teach 12~16 hours per week, for which he/she is paid 2.2 million won per month before tax as a regular salary. Additional teaching hours are required during the semesters and vacations.
c. The Instructor will be paid the housing allowance 450,000 won for the housing maintenance.
d. The College will provide the Instructor a common teachers' room that equipped with computer, telephone, and other commodities.
e. The College imposes a tax on the Instructor's income in accordance with Korean law and pension plan.
f. Insurance: The Instructor is required to maintain some form of Health Insurance for his/her own protection. The Instructor is required to subscribe to the College Medical Insurance Plan, and he/she shall pay the premium fee in compliance with the Law of the National Health Corporation. The Instructor's share of premium payment shall be automatically deducted and paid in each month from the Instructor's monthly salary.
g. The instructor cannot request for extra pay unless it is specified in article 5-b.
6. ANNUAL VACATION:
All Korean national holidays will be observed. In addition, the Instructor shall be given summer and winter vacation. When the summer or winter schools are opened, the Instructor will be required to teach during this time. And the Instructor will be asked to give a lecture when the special lectures are opened.
7. OBLIGATIONS AND RESPONSIBILITIES:
a. The Instructor shall maintain a standard of decency in speech, behaviour and appearance corresponding to that of College professors in Korea.
b. The Instructor shall perform in a professional manner and dignity in the classroom or campus and be an exemplary role model to the students.
c. Behaviour that discredits the College and/or lowers the esteem of one's instructorship is cause for summary dismissal.
d. The Instructor should make constant efforts to develop effective teaching methods and submit research plans and results to the Dean of Academic Affairs.
e. The Instructor should request permission for any off-campus educational activity from the College.
f. In case of the departure from the country during the vacation, the Instructor should submit departure report specified the purpose, period, return home date, and emergency number to contact to the College.
8. OUTSIDE EMPLOYMENT:
Korean visa regulations prohibit the acceptance of pay from any organization other than the College for any Instructor receiving the entry visa based on the guarantees provided by this College.
9. The College provides all the necessary forms and guarantees to enable the Instructor to apply for the Republic of Korea entry visa, and the Instructor should obtain the necessary visa to perform the duties faithfully at the College under this Agreement.
10. Any of the article in this Agreement shall not be changed or modified otherwise described herein above by mutual consent.
11. Any dispute or claim arising out of this Agreement shall be required to be resolved in accordance with the terms of the College regulation and customary law of Korea.
12. This Agreement shall become valid and effective on the date of execution hereof signed by the President of the College, and the Instructor in the space provided below.
