my current e2 visa is going to expire on feb 20th and there may be a bit of a gap between me getting a new e2 for my new job and that so I was thinking about just getting a spousal visa (my wife is also american) to cover myself for a couple of weeks until my new e2 comes through.
with all these new e2 regs has anybody done this yet? |

You can't get a spousal visa unless your married to a korean |

He wants a dependent visa, I believe that's an F3, but could be F1. |

You can't get a spousal visa unless your married to a korean |
Yes, he can.
If you are married to someone here who has a work visa (like an E2) you simply go to the immigration office and change your status of sojourn from E2 to F3 (dependant family).
You will need your passport, ARC, application, fee, AND a copy of your marriage certificate along with HER ARC, passport and proof of employment (certificate of employment from her employer).
Be sure to do it BEFORE your ARC expires or you will have to leave and return to legalize your status before you can get your F3.
Changing from F3 back to an E2 will be the same as a new E2 application with the exception of the consular interview.
