So I'm having a juvenile record expunged. It was a single misdemeanor offense committed 15 years ago. I went through a first time offenders program which meant there was no conviction. In my state the law says that you can request the court to expunge the record if you've had no offenses 3 years after your offense. I never really worried about it, until now, but now, I'm going ahead and getting it expunged.
And guess what? Expungement is going to clear the arrest off my records as well.
I thought I could just write a letter to the appropriate court clerk to have it done, but I found out that doing so will only get them to destroy the court file. To get the arrest removed, that requires a motion being filed.
So I'm hiring a lawyer. I've already spoken with him. The whole process takes 6-8 weeks he said, and when done, the arrest will come off my record, the file will be destroyed, and I will be able to legally tell anyone who asks that it never happened (got that directly from my lawyer).
I know that many states have similar laws and rules. You may want to check it out. Sometimes first offenses can be wiped even for adults, in some states. |
