I know under section 54 of the Labor Standards Act - it's required that employees receive a 30 minute recess period for every 4 hours of work. But does it say 'anywhere' in the LSA - when this recess period can be given?

For example - would the recess period count if they give it to you at the beginning or end of the shift? And if not, where does it say this in the provision?


Why is it bleeping the word "shift"?

A break at the beginning or end of the day does not (and should not) exist. A break should be after you have started, and occur before you finish. I know some people that make a trade off where they negotiate with their employers to let them out early for example to take no breaks.

Call Labor if you are working 4 hours and not getting a break. I know its not a long time, but at the least you should get paid for 4.5 hours if you don't have one.

Call Labor to confirm, but the break must be given in such a way so that you are not working more than 4 hours in a row. eg If you have a 6-hour shift, then the break can be anytime after the second and before the fifth hours (ie. 2-4, 3-3, 4-2). Once you work 4 hours straight, you must be given a break. More than 4 hours in a row is breaking the law.
