I signed a contract that says I must give 40 WORKING days notice if I'm to leave my job. Someone told me that, even if it states that in the contract, by law I only have to give 30 days notice (Not working days).

Can anyone clarify this?

While the law does say that you only need to give a lesser amount of time, you DID sign a contract agreeing to give 40 days notice. Unless it's full of outrageous conditions that even a lazy Korean official would balk at, I think most legal decisions will side with the contract

I don't think you have much recourse outside of doing what you agreed to do, trying to convince them to cut you some slack, or telling them to suck it and getting on the next plane home.

Many contracts say 60 days notice, which is roughly the same as 40 working days notice. You are bound by the contract provisions, as the law states 30 days and a lengthier notice period of 2 months is not unreasonable. If the contract stated 6 months notice, or 9 months notice, or something like that, it would probably be viewed as unreasonable.

Are you in a hogwan or public school?

Giving notice usually means all he11 is about to break loose.

If you give notice are you then able to go to another school and start a new contract or do you have to go home and begin the process all over again?

Actually the director is super concerned about his reputation... We have a new teacher coming to replace another foreign teacher and he wants everyone to have high morale... Which certainly is not the case... Regardless ever since I gave my notice he's been RIDICULOUSLY nice!!! Creepily nice frankly.

If all hell DOES break loose I'll be up and out of that shit... But I don't think it will... Thanks for the input all!
