Notarization verifies the identity of the signer of a document. In most cases in the U.S., a document must be notarized before it can be apostilled.

If your background check included a signed, notarized clearance letter (i.e., the sheriff signed a letter saying your record was clear and the office notary notarized his signature), you should be fine. If your document was not notarized, or worse yet bears no signature at all, the Secretary of State may not be able to apostille it.

You DID check with your Secretary of State's office to find out the requirements for an apostille in your state, didn't you?

Yes, I checked the req. through the Sec. of State website, which said they apostille documents sent from a govt. office such as a city county building SO I went to the city county building and got a crim check there HOWEVER, the Sec of State said they now need a "notary" so now, I'm going BACK to the city county building to jump through 2 more hoops before I can even get an apostille...the police dept does NOT notarize their crim checks in my state.

I got my form notarized at my bank for free before sending out in the mail to my state police HQ. I live in Virginia.
