Also does anyone who has any knowledge of transfers know if you can start working as soon as you've applied for the transfer, ie before the check comes through??
any info would be much appreciated,

For a full disclosure, which will list every incident you've ever had with the Police, go to the MET. For a basic disclosure that will only list those crimes that are considered 'unspent' go to Disclosure Scotland.
Think you'll need to have the background check in your hand before you start working. I know a lot don't, but as the entry laws have been tightened up, it may pay you to get it all sorted, stamped and approved before you arrive. It may be that you can come out and tell them that your check will be forwarded on to you, but to save yourself any aggro, you'd just as well send it to your recruiter etc along with all your other documents before you get here. With the disclosure Scotland, you can apply online and it'll take about 3-weeks.
Think this needs to be made into a sticky as this question seems to be getting asked every week or so. |

Thanks a lot. Is the basic disclosure form all that is needed for korea? I'm currently at a private school and have been offered a better deal elsewhere so want to transfer..the new place are telling me its fine for me to start before the check comes through but I don't want to get screwed by immigration!
does anyone know where you get the apostilled part done in the uk either? |

Sorry, I can't comment on what immigration do or don't want. I arrived before the new entry laws came into practice, but I was asked to provide a Criminal Check all the same. I simply provided them with the basic disclosure, which in any case is fine as if you had commited any serious offences (sex crimes, robbery, murder etc) they will still show up on the basic dislosure as they will remain 'unspent' for much, much longer than say, a shop-lifting offence you commited when you were 12 etc.
Think you need to be able to prove that you're who you say you are, but I'm pretty sure that they'll except scans of your passport and driving license if you're already in Korea. Takes about 3-weeks (roughly) when you apply online, but I doubt they'll post the disclosure to you out here. Get your Mum or someone to DHL it on to you. |

Technically the seriousness of the offence has no bearing on when it will become spent. The sentence that was handed down determines how long a conviction remains unspent. Of course, the more serious the offence the more likely it is that it will stay on the record longer because they generally attract longer sentences but this isn't always the case if mitigating circumstances resulted in a lenient sentence - a non custodial for example. Convictions that resulted in a sentence of over 2 years - or a similar figure - are never spent. Thus a murder conviction which will inevitabley attract a sentence of at least 15 years will never become spent. Sex offences are recorded on the sex offenders register and I don't think they are ever considered spent either. Bottom line; I think a basic disclosure should be okay! |
