I worked for a shitty uni in Wonju last year and when I changed jobs I was told I would get my severance and pension by the last week of March. I got the severence, but not my pension. So, I called and they told me I had to call the National pension service and request the money to be paid to me. So, I had the assistant at my new uni call, and the NPS said that my last job didn't pay anything in for me. Is there anything I can do about this? I am sure that the deductions were made, and I am fairly certain that they are required by law to make the payments. SO what if anything can I do? |

Are you sure they don't have a private pension (not national?)
Most unis are on a private pension system. They should have something. |

I called the place they told me too call (I don't remember the korean name), or I should say my assistant called them. He asked if Sangji University pays to that pension and they said yes, but that they hadn't paid anythning into the plan for me. So, we called the right place. The question now is, did they deduct the amount and keep it, or was the amount never deducted? Either way they are in violation of labor laws, me thinks. |

Depends which situation it falls under:
1) the uni deducted pension from your pay, but never forwarded the money to NPS
2) they never deducted a dime
If (1) then go to NPS, show them your paystubs to prove the deductions were made. NPS will go after the uni to get the money they owe. If you have paystubs that don't break down your deductions, or you don't have paystubs at all (and therefore not able to prove any deductions to pension were made), you'll have to follow the step below.
If (2) then go to NPS, they will ask you to pay your portion of the pension to the uni, THEN the NPS will go after the uni for the money.
NPS will not go after the uni's money until AFTER you have paid your portion (or can prove that you have paid your portion). |

Thanks for the information. I don't have pay stubs and can not prove deductions were made. What if I go to NPS and pay my portion and NPS goes after the Uni, will they be able to know then whether deductions were made, or should I just assume they weren't and take door number 2? |

You have a big problem, buddy. You don't have proof that the deductions were made. Yes, they were supposed to pay pension. Now, if you pay into the pension, it will be the second time you will have paid since the university already took your money. Of course, you will get matching funds. You will get something out of that. They can, with a little work, force the company to pay pension. It depends on how persistent you are and how cooperative the pension people you are going to deal with are with you.... |
