Hello all!
Quick question. If you get legally married in Korea to a Korean, but have yet to return to Canada, are you technically still considered "single" there?

If you have registered your marriage at a Canadian Embassy, or Consulate, here in Korea and at the local district office where you live in Korea. You are then considered legally married in both countries.

OK. But since we havent been back to Canada together since we got married, there shouldnt be any visa problems for her if we try and stay there long term, correct?

If you mean: will she be a landed immigrant, or have Canadian citiizenship? The answer for both is no. She will enter Canada as a regular tourist. For anything else, you will have to fill out the application forms.

Yes, thats what I meant, thx! But if my wife has no Canadian citizenship or is a landed immigrant, what do I declare on my Canadian tax returns if the government doesnt recognize her yet? Married, single or other?

How long have you lived in Korea for? If you have lived here for over 2 years you are automatically considered 'out of state.'

Yes, over 2 years. So what exactly does "out of state" require as far as back home regarding Canadian law?? Do I not have to file Income tax returns etc. ???

From what I understand you only need to pay taxes the first year you are gone. After that, as long as you can prove that you have paid taxes over here. You should not have to pay any taxes when you return, as long as you resided out of Canada. AKA you have not returned to live in Canada any time imbetween. But if you have any questions just call or email revenue Canada.
