If you are on an E2 it is illegal and it means you pay more taxes, get screwed out of your pension and medical benefits and probably get shafted on your overtime / extra pay for extra classes and you won't be properly compensated for your national holidays (that you are supposed to get off with pay).

There are NO advantages to a foreigner (on an E2) to be an "independent contractor".

If you were on an F2/4/5 visa then it is different because you are not restricted by immigration in terms of additional employment or locations.

Thank you for the reply....basically I am having trouble with boss.
He has screwed up pension, tax and medical.

His answer was to try and register me as an Independent Contractor, even though I'm now an employee...ha ha ha

This place is a joke

In my situation, i don't really give a darn that i'm not in the system for medical or pension. hell, i get paid on time, don't work more than 22 hrs per week, got a nice size cash bonus just the other day, and i don't get taxes taken out of my check.

pretty damn nice, i think. i get treated very well, and any problems i have are taken care of quickly.

sh!t, screw the pension in my situation. i am satisfied with what i'm making for the work i do.

see, this is one situation where it ain't always worth making a big deal over, and making things potentially more difficult.

shoot, i know if i get hurt or need medical attn or something (which hopefully, i won't need), the owners where i work will take care of it. being the only foreign teacher at the school, i am needed.

This is not unusual. Your boss is obsessed with penny pinching, and he is not a good businessman. A good businessman with some training in business or with some common sense will do things correctly. Keep plugging away, and make sure you get your rights...

Tax office helped me out today after 2 hours of wrangling over my worker status. I am now going to be paying 1.7% compared to 3.3% I hope I get a refund for those past 3 years of overpaying!!!! Confused
