I'm one of those fools who signed a contract without reading the bit where it says you have to give them access to your bank account! anyway i set up internet banking which i can't get to work... but i still would like to take the money and run as it is me who is risking getting done by the tax man! so i think i can justify it!

the plan is to go into the bank and report the card stolen so i get it back but without having access to the internet banking i will have to check everyday, till the money is in and then run, i want to know if i stay in korea in hidding for a week or so what would happen at the airport?

1.if my visa was cancelled would i be okay as long as it was within a certain amont of time

2. If the school reports i have done a runner would they stop me at the airport?

3. what are the ods my school would report me to the police as been the tax avoider? seing as that could get them done too? (they are unbelieveably stupid) i figure the money for month is about the tax for a year so if that did happen and i had to pay it... i wouldn't get the money but it would be going to the right place, thats a half victory!

i guess what i really want to know is... if i run and dont leave korea straight away, whats the worst that can happen Question Question Question

This is one of those... they deposit 2.5mill into THEIR bank account (in your name) and then they proceed to deposit 2.3mill into your actual account (figures for illustrative purposes).

If that's the case...aren't you actually stealing?

It looks that way, doesn't it? I'd say the only way to justify it is if they've screwed him over in some serious way. For example: a friend working one of these programmes didn't get paid, and they said they weren't paying him until he complied with some arbitrary demands they made. What did he do? He took the money and held it ransom until they promised to pay him on time from then on. When they did, he gave them their money back.

OP: if you're leaving Korea, I really doubt the tax authorities will chase you for a few hundred dollars. This doesn't seem like a valid justification for taking the money and running. From my understanding though, if they do report it as stolen with the police you will get stopped at the airport.

What I don't get is how the boss can even report this, seeing as how they are violating the law by using the teacher's name to hold the money.

Dubious morality aside, here are the facts as the Police should see it.

1. The PS pays the foreign teacher by depositing money into a bank account in his name.
2. The Foreigner withdraws the money from a bank account in his name.

What exactly was the crime?

They could report you for theft or cancel your visa, so you would be detained or have to pay a big fine when you do try to leave Korea.

how big a fine? i meen if they cancel the visa? is it worth it?

can i not extend as a tourist after the visa has been canceled?

the last two times i left was after my visa ran out and both times they just told me how bad it was to stay after the visa had finished and that was it! I think i could take that...

Actually, they can report you for breaking a contract (the second contract you signed with the management company), but it isn't theft if you have a contract with the school for that amount. That doesn't mean they can't report you for theft. But if they do, you show your school contract and your bank account and you would be fine.

They could try to go after you for the breaking the management contract, but that's a hassle and leaves them open to being caught for their tax avoidance.

If you have two contracts, you could take over the bank account and not leave and then if the school doesn't pay you the next month, you can go to labor for the pay. Beware you will be taxed on the whole amount and the school doesn't take out sufficient taxes. You could hold back money for the extra taxes and pass the other money on to the company. After you pay your taxes you could then return whatever part of "their" money is left.

If you file taxes properly, you will owe about 1-2mil more per year than the school is withholding because you are being taxed on the larger amount. Also, you national health insurance will be taxed at the higher amount.

If you take the money and get out of dodge, you are off and away (immoral on your part but questionably not illegal - the account was in your name but 2 wrongs don't make a right.)

If you take the money and stay (even for a short time) you are asking for problems and the necessity of defending yourself against trumped up charges of theft or worse.

IF this is the case you will be grabbed at immigration as you try to leave, have your passport impounded and you need to remember that you are not at home anymore.... You are guilty until proven innocent and could possibly end up in detention pending the determination of your case.

Depending on the amount you abscond with you may just end up facing the Korean version of Guido and the boys. I'm not sure which would be worse and you can be assured that it isn't worth it for a couple thousand dollars.

This whole scenario ignores the morally of the issue. They may be cheating the government but from your posts it does not appear as though they significantly breached YOUR contract.
