Hello Everyone,

I'm new to this forum. I recently quit my job at one school because my director is very crooked. She seemed okay with my quiting until I got my last paycheque on my last day. I thought she might try to screw my last paycheque but I was surprised by the amount she took from my for bogus expenses and other crap that goes against our contract.

Is there any place I can go to, in order to try and force her to pay that money. It is a pretty open and shut case in my favor for anyone that reads the contract. I doubt the labor board would care but I haven't ruled out going to them. It was with the Jungchul Academy if that makes a difference.

Any suggestions would be helpful.

I can't offer any suggestions without knowing the specifics.

Why do you think the Labor Board wouldn't care?

Umm...how about some more details about the situation? The "crooked boss" thing is way too vague.

Okay here are some specifics:

1) We orginally agreed that I would work unitl May 15th. Then she tells me my last day is May 7th. Payday is normally the 9th or 10th. She took off two days wages and said it was because I didn't until the 9th. However the pay period is from the 1st to the 30th of the previvous month. I should be getting the full amount plus 7 extra days in May.

2) All of the expenses were padded. My phone was disconnected twice during the 5 months I worked there, for failure to pay, even though she always took money out of my paycheque. During the last month the bill was 60 dollars instead of the normal 30 dollars. In addition, my electric bill was highier then in the winter, even though I never used the air conditioner and had stopped using the heater a long time ago. All of the padded expenses really added up.

3) She charged me for half the plane ticket. I don't dispute the principle since it was in our contract. However, she had an inflated number of like 600 dollars. I had a copy of the receipt online of the true amount of 400 dollars. When I showed it to her, she still wouldn't give me any more money back.

4) With all this crap, I thought it was time to demand back payments for health insurance. Our contract clearly states that she is suppose to pay for 50% of health insurance and has to give me proof of health insurance upon request. I tried asking for this earlier in my time there, but it was like talking to a wall. So now I wanted all the money she was legally suppose to pay. She refused.

5) She took a deposit from me even though there was nothing in the contract about it. Previvously, I told her I thought it was wrong and I wanted my money back. She said she would on the last paycheque minus expenses. I had a feeling these "expenses" was her way to keep the money she basically stole from me.

I still don't buy it. You are a grown up that signed a contract right? Did you get paid on time? Do you have have proof that health insurance wasn't being paid after the 45 day minimum that you are allowed that (did you request HI)? Did you give a reasonable amount of notice when resigning?

If you have documentation, you can win at Labor. You will need to have the help of a Korean friend because the forms and hearings are all in Korean.

Tell you boss that you're going to file a complaint with the....

Tax Office...
The Pension Office....
and the Health Office.

Then do it.

THe Koreans that I know, both clean and drty, are scared silly of the tax office.
The other two would just suck to have to deal with.
