Taxes out of check when teacher is illegal?

I'm asking for a friend. She just got her first paycheck while teaching illegally (she is waiting for visa number). But they deducted taxes. Are they supposed to do that?
Also, they deducted for national health insurance and pension, even though she doesn't have her ARC number yet. Thank you for your help.

If she has her visa but not her ARC it may be legit. These deductions are usually back dated to a persons LEGAL beginning of employment.

If she does NOT have a visa yet, nope... the employer just got a free dinner out at her expense.

Does she have any recourse? Any tips on what she can say to them or have her recruiter say to them?

Walk out. If she is illegal she has NO options other than quitting or accept the fact that she has a criminal and thief for a boss.

She had left one job and gotten a contract with this school. But the documents she needed didn't come through in time. Then they had to "verify" her degree. It's a long story. At any rate, she's very uncomfortable teaching illegally, but she didn't have the money to go home and start over.

Some people do not choose to teach illegally.

Some....believe what their new employer tells them...not realizing that their new boss has less moral integrity than something you scraped off your shoe.

Some assume that since Korea is a first world country and the sparkling something or other, that things work in a similar fashion to whatever 1st world country he or she came from.

Or, quite possibly, his or her friend simply didn't give a shit.

Korea doesn't yet hold first world status. And, if they can't get on page about the free trade agreement they might find themselves back in the third world bracket.

My friend DOES give a sh*t. As I said before, she is very uncomfortable teaching illegally. Without the financial resources to go home, what was she to do? It's easy to say that she didn't care or that she was stupid or whatever.

But have any of you ever been in a similar situation? If not, what would you have done? When you're struggling for survival, it's not always easy to tell the forest from the trees.

I was in that situation and I just told my boss that he can't deduct taxes because then he would get found out, and be in a lot of trouble. So he didn't deduct a thing. Laughing

THAT is her problem. She has got herself into a financial situation in a foreign country and she can't get home.


What was she thinking? If she is old enough to be out here on her own she is old enough to have an exit plan in place for when things go wrong.

It's her fault and if she isn't capable of taking care of herself then she shouldn't be out of her home country.


BTW I thought you were all legal now.....or have you still not got your visa number yet. Cool

obviously the girl is surviving. she's working (albeit illegally). it ain't her fault that her boss is a caniving bastard who took taxes out of her illegally earned wages.

look, do as ttompatz suggests, remind her she can just walk out. i would. or, she could just make it clear...soemthing like, "look, you know i'm working without my papers. so, no taxes are to be taken out." if they have a fit, F 'em and walk.

i would have made it clear to the boss once i noted money taken out for taxes. i mean, taxes!! hell, she doesn't even have the visa issuance number, and they want to take out taxes. that's just BS.
