I have the enviable job of rewriting my school's contract for future teachers. One area that I'm not sure about concerns sick days.
Currently, the contract says:

Sick Day: if the Instructor is sick and cannot come to work, the person should inform the School before the class begins, and the pay of the day will be deducted from the salary and the money will be give to whomever teaches the absent Instructor's classes. |
Is it legal for an employer to deduct pay on sick days?
Are there minumum sick days guaranteed by law?
What is a fair way to word this clause? |

An unpaid sickday equates to deducting a days pay from the monthly salary. I'd remove the bit "and the money will be given to whomever teaches the absents Instructor's classes." Otherwise the clause sounds fine.
There is no minimum amount of sick days guarenteed by law, but 3 days is a minimum that I and most other prospective teachers would expect. |

SMOE gives 15 paid sick days and 15 unpaid. If you are gone for 5 in a row, you have to show medical evidence of sickness. Shoot for this. |

GEPIK is the same.
Many hakwons (including all of the hakwons I have worked for in the past) have offered 3-5 sick days per contract without a deduction in pay.
There is NO requirement in law for "paid sick days". It was removed from the Korean Labor Standards Act back in 2003.

I wish you the best of luck OP. The smart teachers wouldn't sign a contract with that clause in it. Stupid teachers would sign a contract with the above clause in it. |

Giving someone 5 paid sick days over a year-long would be reasonable.
Also, giving someone 20-30 days consecutive (with only 5 paid) without loss of job would be reasonable. Be sure to include this.
If I got hit by a bus while lawfully riding my motorcycle, I shouldn't have to give up my job if I'm laid up in the hospital for ten days. |
