Hey everyone, I am heading back to Canada after spending two years here in Korea.
I am filing for non-residency for the past 2 years and I need help answering a few questions on the form.
There is a section called STATEMENT OF RESIDENCY. The questions are yes or no answers.
1. Are you, under a tax treaty with another country, considered resident in the other country and not resident in Canada?
2. Are you subject to income tax in that country on your world income? (total income from inside and outside of Canada)
3. Are you considered resident of a counry that does not have a tax treaty with Canada?
I am assuming for question 1 it is a No, question 2 I am not sure unless I am permenantly living here in Korea and have the proper visa but that was the "intention". Question 3 I am not sure of either.
Anyone that has done this before, if you could let me know what you answered for those questions it would be appreciated. Thanks. |

Hi!
Hopefully someone who has actually filled out and filed this form will reply, but I'd say answer to #1 is yes. #2 no and #3 no.
Canda and Korea do have a tax treaty http://www.fin.gc.ca/treaties/Korea_2e.html It means that you're not going to get taxed twice on your income. I'm not sure if you have to prove that you've paid income tax in Korea (surely you have paid it, though - as you are required to do. I've paid mine but would have a difficult time proving it.) but for #2, you're not paying taxes on any income you might be earning in Canada - from say rental properties or what not. If you're not gaining income from any source outside of Korea then it's a non-issue that you're not taxed here for it![/url] |

| Thanks for the reply. What you said makes sense, but I too also hope that someone who has filled it out before can clarify things so that I am 100% sure. |
