WASHINGTON - Federal agents may take a traveler's laptop or other electronic device to an off-site location for an unspecified period of time without any suspicion of wrongdoing, as part of border search policies the Department of Homeland Security recently disclosed.
Also, officials may share copies of the laptop's contents with other agencies and private entities for language translation, data decryption or other reasons, according to the policies, dated July 16 and issued by two DHS agencies, U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.
"The policies . . . are truly alarming," said Sen. Russell Feingold (D-Wis.), who is probing the government's border search practices. He said he intends to introduce legislation soon that would require reasonable suspicion for border searches, as well as prohibit profiling on race, religion or national origin.

Expect incoming laptops to be searched.
Expect downloads to be looked at, possibly forwarded to the MPAA.
Expect to be sued if this continues.

They can't check all those damned laptops as that would take so much time, man power, and effort, not to mention, how pissed off everyone will get. This would be the end of air travel in the US as we know it as it would shut the industry down if they search every laptop. I knew all along that any laptop is subject to search, tecnically speaking, but that most are not. This may change where every laptop has to be screened and if it's OK, you're given your laptop right before you board your flight or sometime after deplaning upon arrival. This would mean you have to arrive at the airport even earlier and then leave much later after your flight lands.
The US is just a police state looking to make most people fail and be imprisoned by whatever reasons and means they can push through the legal systems. As the English would say, "bollocks!" |

Anyone with half a brain knows NEVER to go through customs with data & if you really needs stuff, then upload it to a net storage site & download it when you get to whereever you're going.

I'm no full-brainer but I was under the impression that if it's been on your computer, it'll always be there...so unless you intend on traveling with brand spanking new computers, if it was there, it'll always be there, and they'll find it. |

No, a hardisk has to be wiped twice. Data is not erased until something replaces it where it's located on a hard disk or solid state device such as a USB card. This means 2 formats or complete rewrites of other data to wipe a memory device clean. Fill it up 2 times or format it 2 times to clean a device of what it once had written on it.
A special program is required to recover data that has been deleted, but is still on the memory device which is widely available in the form or data recovery programs in the event you accidentally delete something. This can also be used to do a search warrant on your memory devices to see what you have or did have. It's not forever detectable of what data you've had. |

Usually older files become insanely degraded, that even the best recovery tools cannot bring them back to life. This is especially true for large media files. The more you use your drive, the less likely they'll be even on the deleted list after a while. |

Actually this has already happened to me. I not only had a laptop, but also a camcorder, hard disk and digital camera. |

Just a few questions:
Does this include PMPs & mp3 players?
Will they go through checked luggage?
In what manner do they go about checking the validity of such files? Online receipts?
Any good sites which allow storage of downloaded files? |

Hey peeps!
This isn't bullsheit - it happens.
Buddy flew back to Toronto via Chicago (I think) and at some point going into Canada the officials took his laptop / notebook computer.
He was like, "WTF! you can't search my computer!!"
They said, "YES we can!"
So he asked them what it was that they were looking to find on his computer and they told him that since he was coming from Asia that they wanted to make sure that he wasn't a pedaphile with child porn on his computer.
This happened shortly after Neil was arrested here in Korea.
Looks like the heat is still on for that. |

I'm no paedo, so that's not why I posted this. I'm thinking more in terms of the feds handing the info over to the MPAA. I read an article about how the MPAA was pushing for that and dismissed it outright until I read the article I posted above.
What's truly screwed is I have downloaded movies on my computer, but I own those downloaded movies. Its so much easier to torrent a film rather than dump and reencode it. Same with music.
Yet they could nail me just for having the downloads. That's what blows me away. |

Searching for pedos is to keep the Security Mom's happy (Michele Malkin, O'Really and those biatchs). In this case, a legitimate angle, but still employing the fear factor.
And yes, they can search your checked luggage at Customs anytime they ask. Watch those dogs too, they could sniff you out if you have bags that carried 'stuff' in the past. Then when they don't find anything, they start digging deeper--depending on what kind of mood your searcher is in. Some become convinced they can find 'something', anything... Then they spy your laptop.
But it's banking records and transfer info that they'll be looking at to fight the War on Terra. Mucho dinero coming and going? Taxman might be interested too. |

My laptop is password protected but I'll probably unlock it for them if asked. Much better than them taking it from me for who knows how long. |

Going out isn't as much a problem, Footie. Unless you're coming from Los Alamos maybe. It's coming back in where US Customs does their checks. |
