I have a friend who's finishing a contract at a school that's notorious for pulling every shady eleventh hour scheme possible. She's completed her contract, and is moving to a new school soon there after.
She's asked for a letter of release, and they say they won't give it to her because they claim it leaves a black mark on their record at the labor board.
She is under the impression that she has to do TWO visa runs to Japan. The first two cancel her current E-2 in case her school doesn't file the paper work with immigration to cancel the current E-2 (which could be likely, given their vengeful nature), and the second, a week or two later, to get her new E-2 visa.
This sounds too draconian to be real, but since this is affecting her sanity, and since I'll have to deal with this too, I'm wondering:
1) What's the process for starting a new job your 2nd year if the school simply will not give you a Letter of Release when you finish your contract?
2) If your former employer chooses not to cancel your visa at the end of your contract, what are your options to get a new one when you find a second job?

I am confused? Did you friend finish the first contract? If so she does not need get a letter of release. All she has to do is make sure she leaves the country when her visa/ARC says to. If she needs to stay longer she can get an extension. It sounds like your friend wants to stick around to find a another job after she has finished her first contract. So if she wants to stay she might have to leave. |

if you finish your contract...you don't need a letter of release
hand in your ARC on your way out and your visa is cancelled

1) When the contract is finished, it is finished. Your obligation to your previous employer is ended (and their sponsorship of your stay in Korea is also ended).
Leave the country.
2) your employer does NOT need to cancel your visa at the end of the contract. It will expire on the same date as her ARC.
Leave the country.
3) find a new job, apply for a new visa and start again.

She's already got the job lined up, and the new employer wants to get her working ASAP, preferably the monday after her previous contract is up.
Correct me if I'm wrong, but from what I understand, she can't just have her current employer end her visa when the contract is completed and have her new employer pick up the sponsorship. She'll need to actually get a new visa number, and to get that she needs to end her current visa by leaving the country on or before her ARC expires. |

The post is confusing. Is she done NOW or not?
Normally, a visa expires very close to the time a contract expires, so there shouldn't be any worries in this situation. |

Sorry for the confusion. Her contract is up in 3 days. She has not finished it yet, but has a new job lined up already. |

That's what I thought visa runs were, but she's telling me that her NEW employer can't even apply to sponsor her E-2 because she already has one at the job she finishes this friday and her ARC expires on Sunday.
Can someone apply to sponsor your new E-2 while you currently have an E-2, or do you need to leave the country?
