I got my CRC and I have a criminal record. 1997/01/12 arrested for being under the influence of a drug. PROS REL-DET ONLY-LACK OF SUFF EVID

That's what is says. I remember it clearly. I passed the breathalizer so the cops were sure I was high. They arrested me and booked me and took a blood sample for evidence. The blood test was negative and all charges dropped, but I think immigration will see the word DRUG.
What should I do now ???

What can you do?

Just go ahead and take your chances. If you have to present it in person, maybe have someone on hand to to explain you were never charged.

How could you get arrested If you were doing nothing wrong?
You passes the breathalyzer.
You weren't under the influence of any drugs.
How did you get in trouble in the first place?

it should only be on there if convicted.

If it was just a charge, just ask for it to be deleted.

I was driving my company's car and the officer pulled me over at 4am and told me I had a broken tail light.
I had a lot of Mountain Dew and coffee that evening and he thought I was under the influence. He told me to close my eyes and tell him when one minuted had expired. It was cold and raining and I wasn't able to judge an exact minute. He said I was tweaked out on drugs and gave me a breathalizer test. He then check my nose and said he saw crystals and I denied everything, but he didn't believe me.
He arrested me, took me to the station, booked me and had a nurse come and take a blood sample for evidence. A week later all charges were dropped due to lack of evidence. I supposed the blood test was negative and that was the end of it, but its not the end. Now I'm F*ed here as I'm sure I can't get a Visa for next year.
I have until the end of OCT. to fix this.
How can I get this deleted ??

Where are you from?
If you're from Canada, get your CRC done at a local police station. RCMP guidelines are that they do not show minor stuff from a long time ago if there has been no further activity.
If you're from the states, get one done in a different state.

I'm from California USA.
I got the record from the FBI

I'm not sure if a local check will work because I think its all linked to the same database.

Many of the states do not have information reciprocity. Just get it from another state, and don't use the FBI.

You should be able to get it expunged from your record. I am not sure how to go about doing this, but a lawyer should be able to handle it for you.

Make the effort to get it expunged. It's an employers market in the US, even low level jobs there are doing background checks now. Korea is not the only place where this record could cost you a job. An unsubstantiated drug offense, even in the United States, may mean the loss of a job you want. If you can't afford an attorney, search for your state's law regarding criminal expungement on the internet. In some states, the local courthouse will help you by giving you a form to fill out. If your courthouse won't help you, try talking to someone in a law enforcement records department. Someone will have the answer for you if you keep looking.

Seems like this should be fixable, but the wheels of bureacracy move slow. Why did you wait until the last minute to deal with this? Are you Korean?

Not true ... The CRC needs to be from the same country as your passport.
