|
|
Hello,
I recently got a visa issuance number from an organization, but I never signed any contract. Now they are stating that I HAVE to go to this designated location though I specified in an email to them that I did not want to go to that school. They are basically saying that I have to go to that school or I cannot work with them. Does anyone have any suggestions on how I can resolve this issue? Is it legal for them to issue me a visa issuance number without a contract? Is this organization do something shady? |

did you send them anything?
I cant really believe it would even be possible to get a visa without sending a contract, and all that paperwork in the first place. |

To receive a visa, Immigration MUST have a signed contract submitted to them. It sounds as though a contract was submitted and your signature was forged or, perhaps, your school simply bribed somone at Immigration to overlook this requirement. Either way, this is a really, really bad sign. If you ever do have any problems, the school can claim that you agreed to certain conditions.
Contact Immigration and see if they had a contract submitted. If so, contest the signature. If not, have the visa cancelled immediately so that you can legally work at another school (you can't work for another school while you have an outstanding visa for another school and it sounds as though this school will not willingly cancel your current visa). |

This can only happen if you sent the required visa documents to someone in Korea ( school or recruiter)
Diploma (or apostilled copy)
CRC - apostilled
sealed transcript
Health statement completed
resume and photo
If you verbally agreed to take a particular job from a recruiter is it very likely that the agent has given your papers to a school and they have put your papers into immigration for a visa in your name. ( if you have signed nothing at any stage then the only person who could have signed the contract and health statement would be the recruiter( on your behalf when he gave the documents to the school director )
In Korea it is more about "the complete set of papers being handed over" to go to immigration rather than any careful checking of a signature on a contract.
You may have even signed a contract you were sent way back at the start of negotiations and faxed this to an agent? if you did this - a faxed signed contract is usually accepted by immigration for a visa.
The major problem now for you is to find out exactly who is your official sponsor and what is. I can't believe you do not know who this will probably be.
It is NOT the recruiter you will be working for, so ask for more details.
With a visa number already issued you are now stuck in a computer system for 90 days not able to take any other job. As far as immigration is concerned it was you who sent the documents to Korea and you who agreed to submit them.
Phoning immigration will get you nowhere if the documents submitted were truly yours and you got you a legitimate visa issuance.
good luck on sorting a solution |

Thanks so much for the information. I did send all of the required docs (except for the contract) so I guess I shot myself in the foot. I had no idea that this could have happened. I should have joined this forum sooner |

tTe option is to:
A) fight to get your documents back (or get another complete set),
B) wait 90 days (until the visa confirmation number expires)
C) and try again (a little wiser this time).
