My friend (who works at a Wonderland) is thinking about going back to Canada very soon to tend to a pregnant wife. She was here until about a month ago when her newly discovered pregnancy forced her to return home.

He's about eight months into his contract now, and his contract states that if he resigns before the nine month mark he'll have to pay for half his original flight over and half his original recruiting fee. While he could wait it out he'd rather not as he needs to be there for his wife.

That being said, is this legal? Charging for a plane ticket after the sixth month? I know most hagwon contracts don't require money to be paid towards the plane ticket if the employee leaves after six months.

Or are airplane fares completely frivolous in the hagwon business?

I don't know what the law says, but if he agreed to it contractually, and it's not AGAINST the law, then he's pretty much obliged...

After all the warnings. YEARS of problems & even publications about the horrific conditions of Wonderland....people still work there. Rolling Eyes

I have no sympathy for your friend (who is a complete idiot).

Anyone who puts themselves in that situation after ignoring all the warning signs deserves no help.

If it's any consolation, his Wonderland appears to be pretty good. Aside from that clause in the contract I don't think he's had any real problems there.

It sounds insensitive, but unless she's without family, I'd consider doing the year. Then he can get return airfare and severance. If I were a wife I'd appreciate an extra $3000, not to mention salary for four months, over my husband's face any day.

Of course, you didn't ask that, so sorry for the advice. Embarassed I think if he signed it, it's legit. However, I'd be curious what sponsorship law with the visa says.

Being there for my child's birth is worth a lot more than $3000.

A runner sounds like the best idea.

Meanwhile, he probably doesn't even know how much the recruiter's fee was. Before signing a contract, you should have proof of receipt for such a penalty clause so to know the amount. But don't sign such a rag in the first place, I guess. That being said, hindsight's 20/20...

He said it was a one month ago newly discovered pregnancy. So she's six months maximum? In any event he can finish the next month to go up to the nine month mark.

A runner would be good, especially if he held onto a return ticket.

It is a reimbursement clause. It's not a penalty clause. A penalty clauses (which ARE illegal) would be something like if you miss a class without prior notice, you will have 50,000 deducted from your salary (they would be entitled to not pay you for that hour since you didn't work it, but to deduct MORE than the hourly rate would be a penalty, and hence not allowed).

Nope no problems. The worst thing about my WL is that the food is terrible.

I don't think it would be that much and I'd have to pay half not the full amount..

Well I know I'd feel better with the extra 3-4G's in my pocket while I'm on the plane home. I want it so I can take care of my baby. My wife can draw EI in Canada and there are friends and family there too. The thing is... I miss her and I want to meet my baby.
