|
|
I have been working in Korea for the past 2 months and am coming very clsoe to going home. From the first minute I was told "we dont follow the contract" My paychecks have been shorted hours, housing items are not supplied, even though they are stated in the contract (e.g. Stove, Microwave). There is no public trasnporation in teh area I am, thus I am foreced to hitch hike home from work everyday (I am not looking forward to this in the winter). There are many other issues I will skip for now.
My question:
If I break my contract, the same one they have broken repeatedly, it states I owe my intial airfare and settlement allownace back to the district.
I have no problem repaying, but how do I pay it back after I deduct waht I am owed (overtime ect..)
(the first 3 weeks I was told they did not have a place for me to stay and was forced to sleep on someeones floor, is that something I can claim, I would have stayed at a hotel, but I could not pay for it)
Should I break it and should I jsut run after my next paycheck?
Can they ban me from entering the country on a tourist visa? I have friends here |

Are you at a hakwon or PS?
IF you are at a PS, then it is time to call your provincial liaison.
If you are at a hakwon, wait till you are paid and leave the next day.
Make damn sure you go to the local immigration office the day you leave and tell them:
a) you quit
b) you quit because of pay and contract issues.
c) you want an exit order.
They will cancel your visa. You can return on the next flight as a tourist if you want and seek a new job. You WILL need a complete set of new documentation for a new job (including CRC, transcripts, etc).
If you just run you will not be able to get a new job for the next year AND if your boss complains to immigration before you do you may get a blackmark in your immigration file that WILL complicate future E2 applications.

Oh mighty ttompatz! If I change from one public school to another after finishing a contract, do I have to do the c.b.c. and health exam again? I was going to leave but decided to take another job. Can I transfer my visa? New transcripts? Help me your worthiness. |

Of course the dishonest hagweon boss is going to say that. The fact of the matter is that the Korean government (Labor Board, courts, etc.) do look at the contract if you have a grievance. Sadly, though, they don't care a whit about you until you hit the six month mark. Your best bet is to bail. From the rest of your post, it seems as the right move would've been bailing on them on Day One! |

I don't know if this was in jest or not but cheap dig aside:
IF the contracts are concurrent you can transfer.
If they are NOT they you will need a new visa with a visa run and all that it entails.
Both cases are subject to the discretion of the immigration officer handling your application. |

If it's public school, I'd talk to your GEPIK, EPIK, SMOE coordinator first. |

Don't even bother talking to them. All it's gonna do is give your anal school a warning before your runner.
Anal school will stay anal no matter who you talk to. They ain't gonna change their ways. |
