severance question?

okay, this is a bit tricky... here goes...

i'm leaving korea on thursday for a month of travel... i renewed with my school for a second year... the school's great, my boss, not so much... i'm afraid about severance pay as i will be using this to travel...

i got a visa extension last week... first question, are visa extensions really just a signature on the back of your arc card? nothing documented in your passport? my second question, my coworker is trying to convince me that the school won't pay my severance til the end of my second year... according to the labor board, they should pay it on my last day at work... according to my boss, they are going to pay me on my last day at work (wednesday)... my coworker (maddog) is convinced that they are going to pull something shady and try to keep my severance... can they do that?

thanx for any info...

check your contract but it should read that you get your one month severance after the contract has been fulfilled (not that contracts are all the valid here). My friend at my current school did exactly the same thing and was OK, and I'm planning to do a similar thing when my contract ends in March and that seems to be OK. much depends on the shady nature of your school and you should know how much you can trust your boss.

but i think they would be very unlikely to keep your money and risk you not coming back for another year, teachers are a very valuable commodity at the moment and the way things are at the moment it would take months to replace you.

about as far as i can throw him...

Your severance is payable when you complete (sever) your employment but can be paid out on request prior to this (provided you have qualified for it.

Your extension of your status of sojourn is just a notation on the back of your ARC

BUT....

If you plan to travel OUTSIDE Korea you MUST get a new re-entry permit.

Your old one would be expired and if you are American your original multi-entry privilage (from the original visa) DOES NOT carry over into the extended period.

Get a re-entry permit or LOSE your working status.

This DOES get put into your passport.

i got the single re-entry permit (put in the passport) when i was at immi getting the visa extension... i had to ask about it though...

so, if i told them i wanted my severance, and my boss has said he will be paying me severance and final paycheck on wednesday, then i'll most likely get it? however, legally, he could keep it til the end of my second year? he was really adamant about me getting an extension, when i simply wanted to get a whole new visa while traveling in cambodia...

If he wants you back he will probably not screw with it before you leave.

To easy for you to get a new job and too hard for him to replace you over something to trivial (unless he is in financial difficulty).
