I am wondering how many folks have had visas rejected due to ancient minor offenses showing up on background checks.

(I searched for similar thread and found none. Please link here if you know of any).

I know someone (ahem ahem) who was arrested about 20 years ago for performing a Korean national pastime (peeing behind a building) but in a U.S. state where such things are known as "public lewdness'.

I wonder what that friend's chances are of being rejected or if there are ways to perhaps explain what a joke it was - to Korean immi.

[In some states public lewdness is a sexual offense. (See Texas.) In my state it is clearly differentiated. I wonder if that would help persuade immi. that it is a minor offense.]

Any similar experiences out there?

What you or your friend could do is simply use an out-of-state relative's address and get a criminal check from that relative's state. Minor things from one state won't show up on a public-domain CRC from another state. Law enforcement folks will see it, but no one else will.

This is where Korea shot itself in the foot, though. Korea claims internet checks aren't good enough, but internet checks are more thorough. The agencies I've used via the internet canvas all 50 states. If I do my check via the internet on a potential employee from Maine, I will find out if he committed an offense, even if minor, in Washington state ten years ago.
