I am currently contracted at a university until 24th of February next year.

However I have been accepted at a different university starting next March

Now approximtately 3 weeks ago my current university handed out 'intent to re-sign' forms on which i ticked ' yes i intend to resign' (I was planning to stay but the new job is too good to turn down)....but I have not signed at new contract


Today my new university contacted my current univerisity regarding releasing me from my current contract and my current university said that they would not release me from my current contract which ends in February...for 2 main reasons, a) because i ticked yes on the 'intent to re-sign' form and b)because i did'nt give them 3 months (as stated in my current contract) notice for leaving

So basically according to my current university I have 2 options

1 - Hand in a letter of resignation effective immediately, and not get paid for January or February, cancelling my visa and having to go on a visa run for the new job which starts in March.

or

2 -Not sign and new contract, wait until my current contract runs out in February (meaning I will get paid for january and february)...however this will not give me enough time to process a new visa in time to start my new job in March

Is my current uni allowed to do this?..i'm really confused and need some extra input/advice

It looks like you're going to have to go on a visa run. If I were you I'd get my new employer to pay for it. Get your documents now and work as long as you can. Maybe your new employer can be flexible with the start date?

thanks but not really ideal, can't see why my boss won't just give me a letter of release!!...i mean it's not like i'm going to be doing any actual work, I'm on vacation until the end of February.

I read somewhere that is illegal for your boss not to give a letter of release??..anyone know anymore about it?
