She gave her public school a 2 month notice on Friday...

Today, she heard from her teacher that she is fired and she needs to pay the school back for the flight ticket...

IT's a nightmare. She suspects they didn't want to here get past her 6 months half way mark so they fired her now.

I told her to contact Dain as the first step, but can the school fire her just because she plans on leaving them??

I think they either have to give her 30 days notice or pay her for 30 days.

She wants to stay. Her plan was to move into somewhere in seoul, go to a hawkwon or something...

Is it possible for her to sign with somewhere before she leaves, run to thailand or something and renew her visa?

Nah, not in Suwon.

She is 4+ months into the contract. She figured a 2 month notice now + the previous 4 = 6months total.

sorry to hear this

I was fearful of something like this happening to me when I gave a month and a half notice before the end of six months

however, I was lucky and the only hassle was the last day trying to be paid on time and correctly

public school supervisor still tried to rip me off, though

goes to show that public schools are just as nasty as any hogwan

can't trust anyone

long story about him trying not to pay me on time

and then waiting till after banking hours on a Friday before I am to leave for the airport over the weekend

also

supervisor tried to not pay me for a couple of days at the end...thought I would not notice or calculate but I had everything calculated and pasted on the desktop because I didn't trust him from day one and thought he would pull something on the last day when I am trying to get out of there to catch a flight

it goes on and on with this guy who is like something from the 1950s and is supposed to be a superivsor in a public school district; knows nothing about what he is supervising, speaks no English, and is unprofessional in communication, etc., etc., etc.

I believe that they have to give 2 written warnings before a public school can fire you. I looked into it when I was thinking of quitting. Almost impossible for the school to do since most of your friend's last 2 months are during vacation time. And a public school FT can only be fired for real reasons and not because they didn't like you.

Your friend should
- contact Dain immediately
- document everything

Let us know how it turns out. I'm sure more and more people will go through this as public schools become wise to the many ways they can save their precious won.

Although your friend was obligated to give 2 months of notice of termination, her principal was only required to give two weeks of notice.

GEPIK 2008 Contract, Article 16.2:

Quote:
In the event that this contract is terminated pursuant to the foregoing 1, school principal shall give the employee a written letter of dismissal notice 15 days prior to the termination of the contract, and pay Employee a pro rated salary based on the number of days Employee actually worked.


I think the first thing for your friend to do is go to her principal with a translator, and explain herself in the nicest, most respectful way possible. She can politely request to be allowed to work out the 6-month term as planned, and not be responsible for the cost of the air-ticket/settlement allowance thereafter. At worst, the principal may not agree to see her, may spend the whole time insulting her, or may agree to her request only to sabotage her for the duration of the two months. Nevertheless, the Principal is the king of the school, so just keep nodding and smiling throughout the meeting, since he or she is the one who can solve this thing in the fastest/easiest way.

Yes, Dain Bae is the next step when seeking a solution, but she has too much on her plate to get back to you quickly, and you may not like what you hear when she does. At that point, this becomes a problem for the labor board.

Personally, it's to avoid situations like this that whenever I notify my employer of anything major, I always form a paper trail by bringing two written copies with me, and getting the person whom I notify to sign off on one for me to keep. It has saved my butt on several occasions. I also find a reason to email my wrangler to "confirm" the notification/decision in order to be able to C.C. the other English teachers to make sure every official pronouncement about me is indisputably public knowledge. It's not foolproof, particularly in Korea, but it helps my case whenever someone tries to brew up trouble.

The downside is that this approach can make you look fussy/"picky" at best, and untrusting/disrespectful/jerkish at worst, particularly to Korean colleagues.

It is, however, better to be thought of as absurdly fussy than to have to go through the he-said-she-said that your friend is about to fight & possibly lose.

Hmm. You'd think it was specially designed to scam honest, notice-giving teachers. You can't quit, you're fired.

Notice: DON'T give notice, JUST RUN.

At that point, telling the principal she's contacting the labor board is the next step.

The next step after that is actually contacting the labor board.
