I'll say one thing, Bush didn't do much scummy in his final days on the pardon front. There was lots of speculation that Conrad Black etc would be given a free pass. But Bush seems to have taken a very responsible, moderate route.

He got his old buddy Scooter Libby out of jail, and gawd knows how many of the other 189 he pardoned or commuted were political friends or friends of friends.

The whole system of letting a departing president pardon and commute sentences undermines justice and democracy.

Such overriding of the judiciary ought to the exclusive privilege of a president in the first half of his presidency, if at all should be in the hands of an individual.

He didn't pardon Libby, though.

As some of the pardons show, Bush pardoned people who might have been jailed by the letter and not the intent of the law.

Any pardon might be considered controversial. What if a person pardoned then went on to commit another crime? Odds alone dictate it will happen. Then it certainly becomes a major liability and may cause a president to issue no pardons for fear.

Most countries, republican or constitutional monarchies reserve for the head of state the right of pardon or commutation of sentence. And so they should.

Clinton, whom I liked, pushed that right too far in his final list. Bush, whom I did not, does seem to have trodden a more moderate path. At least he got this - and two other things - right.




(BTW, the three things are final pardons, free trade and attempts at sorting immigration).
