| I came under the new visa regulations in March, and I'd like to do another contract here, just not with my previous employer (SMOE). Will I have to present my transcripts/bachelor's degree/CBC again? If I had an e-2 before, I'd assume all of that would have to be on file. Any help is appreciated. |

Double yup. And you'll need a VSS with your CBC. Check on current regulations for that. There was a change made as of December 17th where the embassy won't notarize a CBC with VSS if it wasn't done with fingerprints. Check on that...
Get multiple sealed transcripts. Like 3 or 4 or something. Just in case you have to change jobs again. |

Wait...jkelly, call immigration at 1345 before you make any decisions.
You may be able to "transfer" your E-2 visa to another employer at the end of your contract.
I went through this in August. Since I was leaving the country on vacation before my contract ended, though, I had to get a whole new E-2 and jump through every hoop. But if you are in-country it may be much easier for you. Ask immi, and write down names for reference, different people say different things. |

Thanks bibbitybop for the heads up. The only thing is that I want to head back to the States for 3 weeks or so before coming back. Will that affect things? |

It may be easier with the criminal report if you're transferring to another public school job. Other than that, if you're transferring, I don't think you'll need another transcript. You'll just be extending your sojourn.
And don't rely on 1345. |

Yes, it does affect the situation. I don't remember my thead's title. Something like "Getting a new E-2 sucks." It was started in July/August and I remember commenting on it in September for the last time.
In short, immigration gave me, my old employer (SMOE) and my new employer different answers and different instructions each time one of us called them.
It was super frustrating.
In the end, we were told I could transfer my visa to a new employer during the last week of my contract IF I was in the country. I was leaving 2.5 weeks before my contract ended. Immigration wouldn't let me transfer it.
Instead, I had to submit ALL my paperwork for a new visa. To add to the bullshit, immigration wouldn't even start to process my new visa until I left the country and turned in my ARC.
I had to wait 12 calendar days to get my new visa issuance number. If it has arrived in 14 days, which is a possibility according to immigration's 10-14 day estimation period, I would not have been able to get my new visa from the Korean Consulate in time to make my flight.
It was like I was being punished for going on vacation. If I would've stayed in Korea, I could have transferred the visa, but I had vacation and a free ticket home to see my family and friends, so I did the entire E-2 process over again.
Thank goodness I didn't have to go to a 5 minute interview at the Korean Consulate in the USA, right? |

The immigration hotline does give some different answers on different days, but like everyone, they struggle figuring out Korea's insane visa laws, too.
Who else are you going to trust? People working for immigration or your co-teacher? Or a random Dave's poster?

| The best thing to do is to go right into immigration and ask them. Preferable the office where your visa will be processed. |

Wha-? I thought with the new regs, they were finally keeping all your information on file (transcripts, degree, etc).
I'm not joking - thought I read this somewhere! But I guess it was too good to be true. |
