Quote:
A court handed down suspended jail terms to four family members who repeatedly raped a teenage relative who suffered from an intellectual disability.

The Cheongju District Court Thursday sentenced an 87-year-old grandfather and two uncles of a 16-year-old girl to four-year suspended prison terms for sexually assaulting and raping the girl for the last seven years. Another uncle received a three-year suspended jail term.

The court acknowledged that their crime was ``sinful'' as they used the young girl, who is their family member, to satisfy their sexual desires. But it gave the suspended terms, saying, ``The accused have fostered the girl in her parents' place. Considering her disability, she will also need their care and help in living in the future.''

The court added it took the accused people's old age and illness into consideration.

Citizens strongly denounced the ruling, saying the punishments were too lenient for the grave crime. Internet users said it is absurd to release them to ``take care of her,'' as she needs help from others, not from rapists. They also said those committing such a crime do not deserve consideration regarding old age or illnesses.

Some bloggers are collecting signatures to oust the judge who made the ruling. The prosecution also decided to appeal. ``One of them even has a previous conviction for rape but was given a suspended term. The ruling is unacceptable,'' a prosecutor said.

Just another example of the total out and out lack of Justice here in korea.
Handicapped people are victims in the true sense of the word. The locals use them as they have no voice of their own and now, this case proves that they also have no basic human rights. Not even the courts will stand up and help. Sad

It is not just this case, but in Korea, basic human
rights are fundimentally NOT respected at all.

It is time to change this.

(I think this is a perfect case for the old law of why two people don't change their family names) ~ it was ment to help stop this kind of dare I say it... incest.

What a POOR POOR show of this government and legal system.
Speechless to be exact.

Wow, I wonder if someone's life savings was stuffed into a white envelope?

That judge should be removed.

That judge probably isnt even a real judge. He probably bribed someone for his degree and then bribed another judge to become the judge. That really is an injustice...Is this really an OECD country as they like to claim. Seems more like a banana republic.

One problem: no bananas.

Sometimes it is useful that there is an overreactive Internet community in this country. I don't think they are ever able to do anything against caulks like this who deserve it.

I just sent this to CNN, Asia Times and the New York Times.

This is the most primitive thing I think I've ever read about--ever.

Raping a retarded niece and granddaughter? Then releasing her to the rapists' custody?

Animals.

Good. This, in my opinion, is worse than the CPN case due to the family association, number of members involved and disability of the victim.

I'd love for the international community to blast Korea on this. Then Korea could turn around again and explain that foreign media outlets don't understand Korean culture. Or they'd blame English teachers.

If you read the article, almost everyone is outraged at the ruling. This is not another example of what's wrong with Korea, but rather, what's right about it. The fact that one judge made a horrible ruling and the fact that people are petitioning to have his ruling overturned...means that there isn't an "out and out lack of justice here in Korea." Rolling Eyes

I hope the public outcry is loud enough that the criminals get a more deserving sentence and that the idiot judge gets fired.

Talk about justice and injustice...

http://news.yahoo.com/s/ap/20081124/ap_on_go_pr_wh/bush_pardons

Why are these mofos being pardoned for their crimes? Granted, some of the offenses are laughable (unathorized use of a pesticide?) when you compare them to crimes like murder and rape, but isn't a crime a crime? I've never really understood why the Presidential pardon exists...it just seems like a convenient way for some rich, white people to get away with their white collar crimes.

Each of the men should be raped repeatedly for the rest of their lives by any Korean who asks for it. The crime of raping them and punishing them short of death should be made legal and encouraged. All the locks from their homes removed.

The girl was 9 years old when the grandfather and uncles would have started this....grade 2-3 here. I don't understand how one person could do this to their own family member, but I can't comprehend how 4 family members could do this. I just can't comprehend this. Where were the other family members in all of this...the wives of the uncles and their children?

And they get suspended sentences? No wonder people move their children away from this place. Don't they have a jury in the court system here?

No offense mate but your grabbing at straws here. This is not some isolated incident and has occured in many other cases as well. Just look at the fact that it was one of the uncles second offense with rape and his second time getting a suspended sentence.

No matter what way you try and spin this, it is absolutely disgusting, disgraceful and utterly horrifying. Regardless if there is a public backlash or not. There shouldnt be any public backlash to the ruling at all because it should have been a straight guilty verdict, throw them in jail and toss away the key. (Although personally I'm in favour of castration for pedophiles and rapists)

Yes its good that theres public outcry, but to try and sugarcoat this horrific incident as an isolated one and a sign that Korea has a fair/just legal system is totally misguided and frankly lacking in intelligence.
