I've never seen anything like it.

Read Clause 2 where it states "teacher agrees to leave residence in Korea 5 days after termination." That is in direct contradiction to Korea's immigration law of 14 days to leave the country after termination. What, is the employer re-writing Immigration papers, now?

Also Clause 12 about dismissal in the event that there are not enough students to make classes, which is a reality now in the Korean economy, the employee must pay back the airfare to Korea and/or visa trip to Japan, up to 12 months within the contract period (if class cancellations happen within the contract's 12 months).

At that point, I imagine employee won't even have a plane trip home ...either.

Simply, "Get out and leave, our business has folded."

This EMPLOYMENTS AGREEMENT has been made this between,
elementary school, being represented by established under the laws of South Korea (hereinafter referred to as the �Employer�) and , a citizen of , whose passport number is (hereinafter referred to as �Teacher�) under the terms and conditions set forth below.

Both parties agree on the following terms and conditions :

제 1조 (약속)
a. 고용자는 본 계약서에 명기된 기간 동안 를 강사로 고용한다.
b. 강사는 본 고용을 수용하고 최선을 다해 업무를 수행한다.
Clause 1 (Appointment)
a. The Employer agrees to employ the Teacher during the period stipulated herein.
b. The teacher agrees to accept the employment and will work in his/her full capacity for the school.

제 2조 (고용기간)
a. 고용기간은 부터 까지로 한다.
b. 강사의 비자 효력은 계약 만료 후 국내 체류를 5일 이내로 한다.
Clause 2 (Period of Employment)
a. a. The Period of Employment shall begin on and end on .
b. The Teacher agrees to discontinue his/her residence in Korea under the visa status arranged and sponsored by the Employer within five days of the termination of this contract.

제 3조 (의무)
a. 계약 기간 동안 강사는 학교의 지시와 규율에 적극 협조해야 하며 고용자가 요구하는 업무를 수행해야 한다. 교수부장은 본 계약서에 명기된 강사의 임무를 집행하게 할 권한이 있다.
b. 강사는 수업준비를 충실히 하여야 한다.
c. 강사의 업무는 다음과 같다.
1. 교육 프로그램과 자료 개발
2. 커리큘럼 이행
3. 사전 수업 준비
4. 과제물 검사
5. 학생들 상담/평가
6. 교실 정리 정돈
7. 학생 훈육
8. 업무 관련 미팅, 워크샾 참가
9. 학교 방침, 규정 이행
10. 그 외 영어 수업 관련된 업무 이행 (예: 공개수업)
Clause 3 (Duties)
a. During the terms of this Agreement, the Teacher must cooperate and comply with the instructions, discipline of the school and the Employer. He/She must carry out such assignments as directed by the Employer. The Supervisor will be responsible for establishing and communicating the Standard of Performance as related to the duties stated in this contract.
b. The Teacher must have adequately prepared for the classes in advance.
c. The Teacher�s work will include for following :
1. Development of educational programs and materials.
2. Curriculum implementation.
3. Preparing well in advance such as lesson plan, books, materials, ideas...
4. Grading and assessment of students.
5. Student counseling or evaluation.
6. Organizing and cleaning the classroom.
7. Student discipline.
8. Attending staff meetings and workshops.
9. Following all school policies and regulations.
10. Being involved in other activities relevant to English teaching.
Ex) Open class

제 4조 (급여 및 초과수당)
a. 고용자는 강사에게 월 100시간의 수업지도 시간과 수업준비 시간을 위해 2,200,000 원을 매월 지급한다.
b. 급여는 다음 달 15일에 지급된다.
c. 한 달에 100시간이 넘는 경우 초과 근무시간으로 인정되며 초과 근무 급여는 시간당 20,000원이다. (1수업시간은 60분) 워크샾과 미팅 참석은 근무시간으로 인정되지 않는다.
d. 모든 강사들은 수업시작 전 한 시간의 수업 준비 시간을 갖는다.
e. 모든 강사들은 정해진 각 수업 사이에 다음 시간 수업 준비를 위한 시간을 갖는다.
f. 월 100시간까지 근무를 요구할 수 있다.
Clause 4 (Salary and Overtime rate)
a. The Employer agrees to pay the Teacher a monthly salary of 2,200,000 million won for 100 actual teaching hours per month and preparation for classes.
b. The payment of the salary is to be made on the 15th of the following month.
c. Each teaching hour exceeding the 100 teaching hours a month is considered overtime. The payment for overtime will be 20,000 won per each teaching hour. (1 teaching hour = 60 minutes). Attendance at scheduled staff meetings and workshops is mandatory and is not considered overtime.
d. All Teachers must have at least one hour per day of unpaid class preparation time at school.
e. All teachers will have a scheduled block of planning time each day.
f. The school and supervisor can request that the teacher work up to 100 teaching hours per month without overtime pay.

제 5조 (근무시간)
a. 계약 기간 동안 주 5일 근무를 하며 교수부장과 협조하여 근무한다.
b. 강사는 고용자가 지정한 교육 시간표 이외의 시간표를 요구할 수 없다
c. 강사는 한 달에 기본 100시간의 수업을 지도한다.
d. 근무시간 내의 수업시간이 100시간 이하일 경우, 수업에 관련된 업무로 나머지 시간을 대체할 수 있다.
e. 새로운 수업이 개설 될 경우, 고용자는100시간 이상의 강의를 요구할 수 있다.
f. 강의 시간은 1시에서 6까지로 한다.
g. 강사의 출근 시간은 12시이며 한 시간의 수업 준비 시간을 갖는다.
h. 경우에 따라 강사는 아침에 강의를 한다.
i. 학교 여름방학과 겨울방학 기간에는 5조 f항 내용과 함께 기본 시간표 외 별도 시간표로 운영된다. (예:9-5)
j. 강사가 결근을 할 경우, 고용자는 강사에게 근무 시간 외 보충 수업을 요구할 수 있다.
Clause 5 (Working hours)
a. During the term of this Agreement, the Teacher should work in cooperation with the Supervisor from Monday through Friday.
b. The Employer cannot guarantee the Teacher's requested teaching schedule.
c. The Teacher agrees to teach upon 100 teaching hours a month.
d. In the event that the actual number of teaching hours scheduled for any particular teaching term is below 100 hours, the teacher will be required to devote the remaining hours to related academic work under the supervision of the academic coordinator.
e. The Employer can request the teacher to work over 100 teaching hours a month in case new classes are open during the term of this Agreement.
f. Teaching hours will be from 1:00 pm to 6:00 pm.
g. The Teacher must attend by 12:00 pm to make an one hour preparation for the lessons.
h. In the event, there is an occasional lesson in the morning, the Teacher should perform the lesson.
i. During the school vacation periods of Korea, the teaching hours will be different from those in the clause of 5.f of the contract. (ex. 9:00 am to 5:00 pm)
j. In the event that the Teacher misses regular lessons, the Employer can request the teacher to give supplementary lessons during his/her nonwork hours.

제 6조 (퇴직금)
1년 계약 만료시, 한국노동법에 따라 고용자는 한달 월급 분량의 퇴직금을 계약 만료일에 지급한다.
Clause 6 (Severance Payment)
Upon completion of this one-year contract, the Teacher will receive one-month salary of million won as a severance payment in accordance with Korean Labor Laws. This payment will be made at the time of completion of the contract period.

제 7조 (세금과 보험료)
a. 한국 세법에 따라 소득세와 퇴직세는 공제된다.
b. 보험료는 고용자와 강사가 5:5 부담한다.
Clause 7 (Taxes & Medical Insurance)
a. Income tax and retirement taxes will be withheld from the salary in accordance with Korean tax law. Income tax on the monthly salary runs at about 3.3 %.
b. Half of the insurance premium will be paid monthly by the Teacher and the other half by the Employer.

제 8조 (항공료)
a. 강사 입국시, 고용자는 강사의 항공편을 제공한다. 항공료는 강사가 본국에서 선지불하고 고용자는 강사 입국 후 14일 이내에 상환한다.
b. 계약 당시 강사가 국내에 머무르고 있을 경우, 고용자는 비자 취득을 위해 강사를 일본에 보내고 모든 경비(항공료, 사증료)는 고용자가 부담한다.
c. 1년의 계약 완료시, 강사의 주거지에 가장 가까운 공항까지의 편도 항공편을 제공한다.
d. 계약 미완료시, 강사의 이유를 불문하고 강사는 항공료와 비자료를 환불해야 한다.
Clause 8 (Transportation)
a. The Employer will provide an economy class airfare from the Teacher's nearest airport to Korea. A one-way ticket will be booked by the Employer. The Teacher will pay for the ticket booked and the airfare will be reimbursed by the Employer within 14 days after the Teacher�s arrival in Korea.
b. In the event that the Teacher is hired in country, the Employer will provide visa-run to Japan. The expense (airfare and visa fee) will be reimbursed by the Employer.
c. One-way economy airfare from Korea to the Teacher's nearest airport is provided with the completion of one-year contract.
d. If the Teacher leaves the school prior to completing 1 year of this contract for any reason, the Teacher must reimburse the Employer the cost of the one-way airfare or the round-trip airfare of visa-run to Japan and visa fee paid by the school.

제 9조 (휴가)
a. 강사는 국가 공휴일과 학교에서 지정한 휴일을 갖는다.
b. 정기 휴가는 주말을 포함해 여름휴가 일주일, 겨울휴가 일주일로 한다.
c. 결근시 이유를 불문하고 월급에서 공제한다.
Clause 9 (Vacation & Holidays)
a. The Teacher will be allowed for national holidays and vacation that are indicated in a yearly academic calendar of The School.
b. There are two holiday periods : One in the summer and one in the winter. These holidays total approximately 14 days, including Saturday and Sunday.
c. The Teacher will not be paid for any absent periods.

제 10조 (병가)
a. 어떠한 경우라도 사전 예고 없이 결근할 수 없다. 만약 발생시, 계약기간 내에 고용자가 강사를 해고할 수 있다.
b. 병가 결근시 진단서를 제출한다.
Clause 10 (Sick Days)
a. The teacher will not be absent without notice in any case. Being absent without notice will constitute a valid reason for the institute to dismiss the teacher at any time during the contract period
b. Teachers should present a doctor�s note when absent due to sickness.

제 11조 (주거)
a. 고용주는 텔레비전, 냉장고, 부엌, 화장실, 세탁기, 침대, 키친 테이블, 의자, 가스렌지가 구비된 주거를 제공한다.
b. 각종 공과금은 강사가 지불한다.
c. 고용자는 강사의 주거가 선정될 때까지 임시주거를 제공할 수 있으며, 고용기간 동안 주거를 제공하지 않아도 되는 경우에는 매월 일정금액의 주거비를 제공한다.
d. 주거를 제공할 것인지 또는 주거지를 지원할 것인지는 고용자가 선택하며, 일단 선택한 이후에는 고용기간 동안 이를 변경할 수 없다.
e. 고용자가 주거를 제공하는 경우 11조 a항에 명시된 가전제품 및 가구를 제공할 수 있으며, 그 외의 물품을 요구할 수 없다. 제공된 물품에 대한 관리 및 수리 일체에 대하여는 강사가 책임을 진다.


Clause 11 (Housing)
a. The Employer will provide the teacher with furnished accommodation, a bedroom, a kitchen and a bathroom. Furnishings being provided by the employer include : television, refrigerator, washing machine, bed, kitchen table, chairs, two burner gas plate.
b. The cost of monthly services, and utilities charges for the accommodations will be paid by the Teacher.
c. The Employer may provide temporary housing until the appropriate housing for the Teacher becomes available. If the Employer doesn�t have to provide housing for the Teacher, the Employer will provide the Teacher with a specific sum of money per month, as a rent subsidy.
d. The Employer will decide whether to provide the Teacher with housing or a rent subsidy. Once decided, the Employer�s decision will not be subsequently changed during the Term of Employment.
e. If the employer provides housing to the Teacher, the Employer may provide appliances and furniture in the clause of 11.a. The Teacher should not request or demand any other appliances or furniture than those provided by Employer. The Teacher should take the responsibility for the maintenance and repair for the appliances and furniture provides by Employer

제 12조 (해고 및 사직)
a. 아래와 같은 경우 고용자는 강사를 해고할 권한이 있다.
1. 본 계약서에 명기된 의무 불이행 또는 거절할 경우
2. 빈번한 결근할 경우
3. 학생수의 감소로 수업 운영을 할 수 없을 경우
4. 경고장을 두 번 받은 경우
5. 범죄발생시
6. 교외 과외수업 적발시
b. 해고나 사직 어떠한 경우라도 강사가 1년의 계약 미완료시, 강사는 항공료, 비자료, 주거 보증금, 그 외 강사에게 소비된 모든 액수를 환불하여야 한다. 고용자는 강사에게 귀국 항공료를 지원하지 않는다.
c. 해고나 사직 어떠한 경우라도 강사가 1년의 계약 미완료시, 한국 노동법에 의해 퇴직금은 지급되지 않는다.
d. 강사가 사직을 원할 경우 60일 전에 알려주어야 한다.
Clause 12 (Dismissal or Voluntary Resignation)
a. The Employer reserves the right to dismiss the Teacher from employment for the following events:
1. Neglect or inability to perform any of duties stipulated in this agreement
2. Frequent absences from work.
3. Impossibility to maintain classes due to a deficit operation caused by decreasing number of students.
4. Receiving two warning letters.
5. Criminal behavior or misconduct.
6. Teaching any private classes outside the school.
b. In either case of dismissal or resignation before completing one year period of the contract term, the Teacher must reimburse the Employer the airfare and the visa processing fee, housing key money, and other expenses, which have been occurred for the Teacher�s employment. The Teacher will be responsible for his/her return trip to his/her home country.
c. In case of either dismissal or resignation before completing one year period of the contract term, the Teacher will NOT receive one-month salary of million won as a severance payment in accordance with Korean Labor Laws.
d. In the event that the Teacher resigns from employment, the Teacher can do so by giving 60 working days notice to the Employer.

제 13조 (준거법과 사법권)
a. 본 계약서는 한국법에 의해 적용 된다.
b. 본 계약서는 최종 합의 되었음을 알리며 더 이상의 추가수정부분이 발생하여 추가 서명이 되지 않는 한 본 내용에 협조한다.
Clause 13 (Governing Law & jurisdiction)
a. This Agreement is governed by the laws of the Republic of Korea.
b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and the incorporated into this Agreement.

In witness thereof, we have affixed our signatures hereon.

In the holiday bit it implies the 14 days (inc weekends) is unpaid!!!!

What about the clause saying up to 100 hours of UNPAID OT a month can be forced on u.

Or the mention of 1 million won severance (which is illegal rate if this job pays more than that).

Anyone who touched this would be bonkers.

What are you going on about? You have to leave the residence NOT the country. It has nothing to do with Immigration law.

Yes this one is a valid point.



The rest of it is your standard rip-off hakwon contract.

They fire you one day before contract ends, you have to pay them your flight, housing and KEY MONEY plus any other BS they can think of?
